FINANCIAL IMPACT

Approval of Amendment No. 1 (Amendment) to Lease Agreement No. 95-782 (Lease) will not result in the use of Discretionary General Funding (Net County Cost).  County Service Area 29 - Lucerne Valley (CSA-29) will receive no fee for the use of the senior center.  Lucerne Valley Senior Citizens, Inc. will be responsible for all utilities, interior maintenance, and maintenance of the pergola, located at 33187 Old Woman Springs Road, Lucerne Valley.

BACKGROUND INFORMATION

On August 22, 1995 (Item No. 52), the Board of Supervisors (Board) approved the Lease that automatically renewed every year, with Lucerne Valley Senior Citizens, Inc., for approximately 5,000 square feet of a community center, located at 33187 Old Woman Springs Road in Lucerne Valley, known as CSA-29.  The original term of the Lease was for the period of September 1, 1995, through August 31, 1996, with automatic one-year renewals.  The Lease has continued to renew annually on a no fee basis with the tenant being responsible for interior maintenance and 75% of all utility fees.

The Department of Public Works - Special Districts (SDD) requested that the Real Estate Services Department (RESD) add a term to the Lease for a three-year period from March 1, 2025, through February 29, 2028, include a two-year option to extend the term of the Lease, update the maintenance provision for the tenant to maintain the interior and a wood patio shade structure, and update the utilities to be paid 100% by the tenant, for the continued use of the community center for Lucerne Valley senior citizens use in the Lucerne Valley area.

San Bernardino County Code Section 18.0103 allows leases and licenses of a duration not exceeding five years and having an estimated monthly rental or use fee of not exceeding $5,000 may be excluded from the bidding procedures of §18.0101 provided that the actual monthly rental or use fee of the executed lease or license shall not exceed $5,000, the term of the executed lease or license shall not exceed five years.  Notice has been given pursuant to Government Code §6061, posted in the Office of the County Clerk on January 23, 2025.

The project to approve the Amendment was reviewed pursuant to the California Environmental Quality Act (CEQA) and determined to be categorically exempt under CEQA Guidelines Section 15301 - Existing Facilities (Class I), because there is no possibility that the leasing of the subject property will have a significant effect on the environment.  Accordingly, no further action is required under CEQA.
