FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).  There is no cost associated with adopting a resolution declaring that this County-owned property, comprising approximately 99 acres of land, located in the unincorporated area between the Glen Helen and Verdemont Communities, in San Bernardino County (Property), is no longer necessary for the uses and purposes for which it was acquired, and is surplus pursuant to County Policy 12-17 and is surplus land pursuant to the Surplus Land Act (SLA).

BACKGROUND INFORMATION

The Property is part of the closed Cajon Disposal Site (CDS) located in the County.  The CDS encompasses approximately 127 acres of land, 88 of which were used for refuse disposal and 39 of which were not developed.  The site typically accepted non-hazardous residential, commercial, demolition and agricultural as well as septage waste and small quantities of petroleum distillates, and asbestos.  Operations began at the CDS in April 1963, and it ceased accepting waste in October 1980.  The County determined that an approximately 99-acre portion of the CDS, including approximately 45 acres of Assessor’s Parcel Number (APN) 0262-042-19 plus all 54 acres of APN 0262-042-20, is no longer necessary for the uses and purposes for which it was acquired.  Therefore, it is surplus pursuant to County Policy 12-17.  An approximately 16-acre portion of APN 0262-042-19 is not being declared surplus because it is situated within a FEMA Special Flood Hazard Area.

The Property was further reviewed in accordance with the SLA, and it is recommended that the Property be declared surplus land pursuant to Section 54221(b)(1) of the SLA.  In accordance with the California Department of Housing and Community Development (HCD) SLA Guidelines Section 400(a), the Real Estate Services Department (RESD) will provide a copy of the Resolution to HCD for review.

If the Resolution, is adopted by the Board, RESD will immediately notify all appropriate local and public agencies and non-profit entities, pursuant to Government Code Section 54222, of the availability of the Property.  After a period of 60 days, if none of the appropriate agencies and entities respond with interest to lease the Property, RESD will return to the Board of Supervisors (Board) to request approval for the lease of the Property pursuant to Government Code Section 25363 or 25520 et seq.

Staff determined that the designation of the Property, as surplus does not have the potential for creating a significant effect on the environment.  Therefore, this action is covered by the commonsense exemption and exempt from further review under the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines, Section 15312 (Surplus Government Property Sales) and Section 15061(b)(3) (Common Sense Exemption).  Further CEQA review will be required prior to Board approval of any conveyance or lease of the Property to an entity listed in Government Code Section 54222.

PROCUREMENT

County Policy 12-17 (Surplus Real Property) allows for property, that is no longer needed and has no economic reason for retention to be declared surplus and disposable.
