FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as the Department of Public Works - Solid Waste Management Division (SWMD) is financed by fee revenue. SWMD establishes fees that are charged to the public and other agencies for utilization of the County’s Waste Disposal System. The construction contract of $4,260,260 and any use of the proposed contingency fund for the Landfill Gas Flare Station Project at the Mid-Valley Sanitary Landfill (Project) will be funded by SWMD fee revenue. Sufficient appropriation and revenue have been included in the SWMD 2025-26 budget and will be included in future recommended budgets to accommodate the contract.
BACKGROUND INFORMATION
The County's Mid-Valley Sanitary Landfill (MVSL) is located in the City of Rialto, northwest of the intersection of Alder Avenue and State Route 210. The site occupies approximately 448 acres of which 408 are permitted for refuse disposal. The Project consists of constructing a new landfill gas collection and control system designed to safely collect and combust landfill gas. The system will include two enclosed flares to reduce air pollutant emissions. A flare is a controlled combustion device that safely burns landfill gas to destroy harmful compounds and reduce odors and greenhouse gas emissions. The system will also include associated fans, tanks, pumps, and related equipment necessary for the conveyance, collection, and monitoring of landfill gas and liquids generated by landfill operations. Ancillary work includes site grading, demolition, construction of concrete foundations, masonry walls, modification of existing land fill gas piping, installation of new landfill gas piping and electrical infrastructure. Optional work may include demolition, salvage, and relocation of existing flare system components, as well as the providing a temporary rental generator, if required. All work shall be completed in accordance with the approved design documents.
This item supports the County and the Chief Executive Officer’s goals and objectives of providing for the safety, health and social service needs of County residents by enhancing the landfill’s gas collection and destruction capabilities, ensuring compliance with environmental regulations and improving operational efficiency.
Following the Board of Supervisors (Board) approval of this item, construction is anticipated to commence in March 2026 and be completed in July 2026.
PROCUREMENT
This Project was released on the County Electronic Procurement Network on October 28, 2025 and advertised in the Daily Press & Precinct Reporter newspapers on October 28 and November 4, 2025. A notice inviting bids was also provided to specified construction trade journals as required by Public Contract Code section 22036. A mandatory pre-bid meeting and job walk was held on Thursday, November 13, 2025 and was attended by eight firms.
There were four addendums issued during the bidding phase, revising and clarifying the Project plans and specifications as follows:
1. Addendum No. 1: Instructed bidders to disregard the incomplete Special Provisions inadvertently uploaded with the project advertisement and to instead use the complete set of Special Provisions; and responded to questions received from potential bidders. (October 30, 2025).
2. Addendum No. 2: Posting a copy of the Mandatory Prebid Sign In Sheet (November 13, 2025).
3. Addendum No. 3: Responded to questions received by potential bidders (November 19, 2025).
4. Addendum No. 4: Amended the bid opening date from December 9, 2025, to December 16, 2025; revised a section of the technical specifications; replaced the bid proposal sheets; and responded to bidder questions (December 4, 2025).
On December 16, 2025, four bids were received:

Upon receipt of the bids, SWMD conducted a detailed review of all bids to determine compliance with the bidding requirements set forth in the bid documents. One bidder, Stearns, Contract and Schmidt, Consulting Engineers, Inc., was determined to be non-responsive because its bid was submitted on incorrect bid proposal forms, which is a material deviation from the bidding requirements and did not permit a fair and consistent comparison with other bids.
SWMD reviewed the remaining bids received and determined that they were responsive and recommends that the Board award the contract to Sukut Construction, LLC, the lowest responsible bidder. No appeal/protest letters were received.
This Project will have a total contingency fund of $426,026 to compensate the contractor for verified quantity overruns, as well as changes in the contract under specific circumstances permitted by the contract or by law. Under an established formula based on the contract amount, Public Contract Code section 20142 allows the Board to authorize the Director of Public Works to order changes in the contract, including for unforeseen conditions or design shortfalls, should they become necessary in the future for a total amount not to exceed $210,000 of the $426,026 contingency fund.
