Body
COUNTY AND CHIEF EXECUTIVE OFFICER GOALS & OBJECTIVES
Operate in a Fiscally-Responsible and Business-Like Manner.
Provide for the Safety, Health and Social Service Needs of County Residents.
FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The estimated annual cost of $169,200 for the 470 cellular subscriber lines provided by Cellco Partnership, doing business as Verizon Wireless (Verizon) will be partially offset by the one-time Equipment Incentive Credit (EIC) offer of $1,000 per line. After the EIC is exhausted, the ongoing costs will be allocated proportionally between Law Enforcement Contracts and Sheriff/Coroner/Public Administrator’s (Department) stations/divisions based on the number of users. Sufficient budget allocation will be included in future recommended budgets.
BACKGROUND INFORMATION
On December 16, 2025 (Item No. 116), the Board of Supervisors (Board) approved Agreement No. 25-1062 with Axon Enterprise, Inc. (Axon), for hardware, software, Cloud Services with data storage, installation, and maintenance services, including body worn camera system, taser devices, fleet vehicle camera system, Fusus system, and AI Era Plan, in an aggregate amount not to exceed $74,483,396.98, for the period of January 1, 2026 through December 31, 2035. The fleet vehicle camera system, Fleet 3, included in Agreement No. 25-1062 is an advanced in-car video system designed to boost safety and transparency for the Department’s personnel and the public.
The Department currently uses Verizon’s cellular services for secured data transmission from and to the mobile data computers installed in its patrol vehicles to the Department’s network. Verizon has extended a one-time EIC offer for each additional line if the Department activates a minimum of 450 lines. The Department will be activating an estimated 470 lines to provide connectivity to the Fleet 3 cameras. The EIC is subject to the terms and conditions included in the State of Utah contract issued to Verizon through the National Association of State Procurement Officers (NASPO), identified as Master Agreement No. MA152 (NASPO Agreement).
After conducting a competitive bidding process, the State of Utah awarded Verizon the NASPO Agreement for the purchase of wireless data services, voice, and accessories, and made the agreement available for use by other government entities. The State of California does not have a Participating Addendum (PA) to the NASPO Agreement. The California Department of General Services (DGS), however, permits California state agencies and local government entities to enter into their own PAs in order to make purchases under available NASPO agreements, with the requestor having to follow its governing body’s ordering procedures.
In order to take advantage of the EIC offer extended by Verizon, the Department submitted a request to DGS for authorization for the Department to enter into a PA for the NASPO Agreement. DGS approved the request on January 20, 2026.
Approval of this item will authorize the Department’s PA to the NASPO Agreement, permit the Department to accept Verizon’s EIC offer for the activation of cellular service lines, and authorize the Purchasing Agent to execute documents, such as but not limited to contracts or EICs related to purchase orders that may be required for wireless service, software, and other services covered by the NASPO Agreement.
The NASPO Agreement includes terms that differ from the standard County contract and omits certain County standard contract terms. The non-standard and missing terms include the following:
1. Not all County insurance requirements pursuant to County Policy 11-07 are included in the NASPO Agreement; however, the agreement does include terms substantially similar to the County standard insurance requirements, including (i) requiring Verizon to maintain commercial general liability insurance and workers’ compensation insurance and (ii) furnishing insurance certificates evidencing required insurance coverage acceptable to the State of Utah, including endorsements showing the participating States as an “additional insured.”
• The County standard contract requires contractors to carry appropriate insurance at limits and under conditions determined by the County’s Risk Management Department.
• Potential Impact: The insurance provision does not comply with County Policy 11-07 and potential claims not covered under the County’s standard insurance requirements could leave the County financially liable.
The Department recommends approval of the NASPO Agreement with Verizon, including the non-standard terms, as the agreement will provide substantial cost reductions for required cellular service. County Counsel and Risk Management have reviewed the non-standard language and provided input.
PROCUREMENT
County Policy 11-04, Procurement of Goods, Supplies, Equipment, and Services, requires the Department to seek Board approval for purchases of goods in excess of $200,000 annually. Verizon’s pricing is based on the terms and conditions of the NASPO Valuepoint Agreement. NASPO Valuepoint is a cooperative purchasing program that helps facilitate public procurement and is able to provide competitive pricing options due to its collective purchasing power. The procurement under NASPO consists of a competitive process conducted by a lead agency. Utah is assigned as the lead agency, and released solicitation No. CJ18012 seeking contractors to provide wireless data, voice, and accessories. NASPO’s Master Agreement No. MA152 was awarded on August 12, 2019, and has been extended through August 11, 2029. Master Agreement No. MA152 allows other states, local political subdivisions, and other eligible entities to participate in the Agreement. As a political subdivision, the County is allowed to participate in this cooperative agreement. Under this agreement, the Board will sign the Participating Addendum approving participation for the County for the term of February 24, 2026, through August 11, 2029.
