FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).  An easement will be granted by San Bernardino County Fire Protection District (SBCFPD) to Southern California Edison Company (Edison) pursuant to Health and Safety Code Section 13861(b) and Government Code Section 25526.6.  The easement will be granted at no cost pursuant to Government Code Section 25526.6 which states that the Board of Directors (Board) may convey an easement to any public utility corporation in the manner and upon the terms and conditions as the Board determines or prescribes, upon a finding by the Board that the conveyance is in the public interest and that the interest in land conveyed will not substantially conflict or interfere with the use of the property by SBCFPD.  Edison will be responsible for the installation, operation, and maintenance of Edison’s improvements therein.

BACKGROUND INFORMATION

SBCFPD operates Fire Station 3, which provides fire, emergency medical responses, and rescue services for the communities of Devore and Rosena Ranch.  Due to increased development and planned growth in the area, SBCFPD would like to build a new fire station to service the Rosena Ranch area’s projected growth.  The new 3.27-acre site is located in an unincorporated area of the County, at the corner of Glen Helen Pwky and Lytle Creek Rd (Premises).  The total station size will be 15,015 square feet as 12,018 square feet will be the Fire Station and 2,997 will be a Sheriff’s Sub-Station at the Premises.  Completion of the new, larger, modern station will enable SBCFPD to provide expanded emergency services and maintain public safety in the areas it serves.

The purpose of the Edison easement is to establish new electrical service needed to begin operating the proposed fire station.  The conveyance of the easement over a portion of the Premises will allow Edison to install and connect overhead and underground electrical supply systems and communication systems, consisting of poles, guys and anchors, crossarms, wires, underground conduits, cables, vaults, manholes, handholes, and including aboveground enclosures, markers and concrete pads and other appurtenant fixtures and equipment necessary or useful for distributing electrical energy and for transmitting intelligence, data and/or communications (e.g. through fiber optic cable).

SBCFPD reviewed Edison’s request for the easement on the Premises and determined that the easement is in the public’s interest, and the easement conveyed will not substantially conflict or interfere with SBCFPD’s use of the Premises.

Additionally, this item will authorize the Director of the Real Estate Services Department (RESD) to execute other non-substantive documents necessary to complete the easement conveyance, subject to County Counsel review.  The Director of RESD will not be authorized to execute any documents with Edison that would bind the County to any actions not contemplated by, or arising from, the transaction which is the subject of these recommendations.

The conveyance of the easement was reviewed pursuant to the California Environmental Quality Act (CEQA) and was determined to be categorically exempt from further environmental review under California Code of Regulations Sections 15312 (Surplus Government Property Sales) and 15061(b)(3) (Common Sense Exemption) of the CEQA Guidelines.  The Property is not located in an area of statewide, regional, or area-wide concern as identified in Section 15206(b)(4).  Additionally, the Common Sense Exemption applies when it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment.  SBCFPD will have fulfilled the obligations under CEQA for this conveyance with the posting of the Notice of Exemptions by RESD.

PROCUREMENT

SBCFPD can convey the easement to Edison in accordance with Health and Safety Code Section 13861(b) and Section 25526.6 of the Government Code.
