Body
COUNTY AND CHIEF EXECUTIVE OFFICER GOALS & OBJECTIVES
Provide for the Safety, Health and Social Service Needs of County Residents.

FINANCIAL IMPACT
This item does not impact Discretionary General Funding (Net County Cost). The total cost of these contracts will not exceed $7,042,751.01 and will be funded through a combination of 50% State ($3,521,375.50) and 50% Federal ($3,521,375.51) funds. Adequate appropriation and revenue have been included in the Human Services’ Administrative Claim 2025-26 budget.
BACKGROUND INFORMATION
A primary barrier to placing foster children with families is the lack of immediate access to childcare. The passage of California Senate Bill 89 (Chapter 24, Statutes of 2017) established the Emergency Child Care Bridge Program (Bridge Program), which requires counties to enter into an agreement with the local Child Care Resource and Referral Programs (R&R) to provide a childcare navigator for families and trauma-informed care training and coaching services. Child Care Resource Center, Inc. (CCRC) and Pomona Unified School District (PUSD) are currently the only R&Rs contracted with the State to provide services in San Bernardino County (County).
Under the recommended contracts, Children and Family Services (CFS) will provide eligible families with a time limited monthly payment or voucher for childcare for children ages zero through 12 years. Additionally, families will receive support from a childcare navigator provided by one of the R&Rs. Childcare programs and providers serving children in the Bridge Program will also receive trauma-informed training. The California R&R Network will develop and coordinate the training content to be used.
As a public entity, PUSD has certain contract terms that must be included in their agreement which differ from the standard County contract terms. The non-standard terms include the following:
1. The County is required to indemnify PUSD from and against any and all liability, loss, expense or claims for injury or damages arising out of the performance of the agreement by the County, but only in proportion to and to the extent such liability, loss, expense, attorneys’ fees or claims for injury or damages are caused by or result from the negligence or intentional acts or omissions of the County. PUSD is only required to defend and indemnify the County if such liability loss and damage is caused by the negligence or intentional acts of PUSD.
• The County standard contract does not include any indemnification or defense by the County of a contractor. The County standard contract requires the contractor to indemnify the County from any and all claims and damages arising out of the contract from any cause whatsoever.
• Potential Impact: By agreeing to indemnify PUSD, the County could be responsible to defend and reimburse PUSD for costs, expenses, and damages, which could exceed the total contract amount. PUSD is only required to indemnify the County in certain instances, which means that the County may be solely liable for the costs of defense and damages, which could exceed the total contract amount.
2. The PUSD contract does not require the district to meet the County’s insurance standards as required pursuant to County Policies, 11-05, 11-07 and 11-07SP.
• The County standard contract requires contractors to carry appropriate insurance at limits and under conditions determined by the County’s Risk Management Department.
• Potential Impact: The County has no assurance that PUSD will be financially responsible for claims that may arise under the MOU, which could result in expenses to the County.
CFS recommends approval of the contracts with CCRC and PUSD, including the non-standard terms in the PUSD contract, so that they can continue to provide eligible families with a time limited monthly payment or voucher for childcare for children ages zero through 12 years.
This item is being presented at this time as CFS was unable to complete budget negotiations with CCRC and PUSD until after July 1, 2025 as the state budget allocation was not available until August 28, 2025, CCRC and PUSD required time for their budget preparations based upon their review of the State budget allocation. This is the first date available for Board of Supervisors approval following the required operational, fiscal, and legal reviews. There has been no impact to the community since CCRC (Contract No. 24-484) and PUSD (Contract No. 24-485) continued to provide services in good faith to prevent break in services, after the previous contracts expired on June 30, 2025. These contracts require retroactive effective dates of July 1, 2025 to ensure there is no lapse in services and to ensure CCRC and PUSD are reimbursed for the services carried out beginning July 1, 2025, during the negotiation period.
Services provided under these contracts may be terminated by the County without cause upon 30 days prior written notice. Contractor performance will be monitored by review of monthly reports and an annual site visit to ensure compliance with the administrative, program, and fiscal terms and conditions of the contract.
PROCUREMENT
Purchasing supports the non-competitive procurement of Emergency Childcare Services, as required by the State, which mandates that the County CFS department utilize state approved R&Rs as part of the Bridge Program, which provides crucial support to families in crisis. The vendors referenced above are the only approved R&Rs in the County.
