FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The recommended construction contract in the amount of $6,136,316 will be funded by the Sheriff/Coroner/Public Administrator’s Aviation Flight Line Pavement Replacement Project (Project) (WBSE 10.10.1932), which has a total project budget of $11,437,410.

On June 10, 2025 (Item No. 136), the Board of Supervisors (Board) approved Discretionary General Funding for the Project. The Project was subsequently included in the 2026-27 Capital Improvement Program (CIP) budget, approved by the Board on June 9, 2026 (Item No. 126).

BACKGROUND INFORMATION

In 2014, the City of Rialto closed its airport located at 1776 Miro Way forcing the Sheriff/Coroner/Public Administrator (Sheriff) to relocate their Aviation Division (Aviation) to approximately eight acres of leased property located on the San Bernardino International Airport Authority (SBIAA) airport grounds.

On February 25, 2014 (Item No. 45), the Board approved Lease Agreement No. 14-74 (Lease Agreement) with the SBIAA for an approximately 61,640 square foot aviation facility consisting of a 27,500 square foot aircraft maintenance hangar, a 22,500 square foot storage hangar and 11,640 square feet of office space plus 348,639 square feet of site work improvements for a 25-year term.

According to the Lease Agreement, everything within the gated complex containing Aviation is considered “demised premises” and is therefore the County’s responsibility for maintenance and repairs. The asphalt within the parking areas and flight line is original to the facility and has not undergone significant maintenance since its installation. The pavement has deteriorated over time, resulting in cracking and loose asphalt in several areas. These conditions present potential safety concerns for personnel and may cause damage to aircraft, particularly within the flight line area.

The Project includes demolition of approximately 350,000 square feet of existing pavement and valley gutters and construction of new Portland Cement Concrete pavement, new striping to include pavement and touchdown and lift-off helipad markings, new storm drain system, lighting improvements and adding a new manual gate. The construction work will be done utilizing a phased approach to minimize the impact to daily operations of the Sheriff’s Aviation division.

On June 22, 2026, in accordance with County Policy 11-15, the Assistant Executive Officer (AEO) reviewed and approved the Project plans and specifications and authorized PFMD to proceed with procurement and advertise for competitive bids.

The AEO also approved the Project as categorically exempt from further review under Section 15301, Class 1 Subsections (a) (c) and (d) (Minor Alteration of Existing Structure) and Section 15302 Subsection (b) and (c) (Replacement or Reconstruction) of the California Environmental Quality Act Guidelines (Title 14, California Code of Regulations) for existing facilities. No further environmental review is required.

Approval of this item will allow Project and Facilities Management Department (PFMD) to award a construction contract to Griffith Company for the Project located at 199 Hangar Way in San Bernardino.

PROCUREMENT

On June 22, 2026, pursuant to County Policy 11-15, the AEO authorized the Director of PFMD to advertise for competitive bids for the Project. PFMD advertised for bids on June 26, 2026, in the Sun Newspaper, six plan rooms, and on the County’s Electronic Procurement Network via Request for Proposals (RFP) No. ANE223-ANE2C-6416. On July 31, 2026, Addendum No. 1 was released, which revised the bid opening date from August 5, 2026 to August 12, 2026.  On August 6, 2026, Addendum No. 2 was released which revised the advertisement for bids and instructions to bidders by extending the bid withdraw period from sixty days to ninety  days; revised the prevailing wage attachment; updated the plans to include SBIAA review and approval stamp on all sheets and revise sheets E-01 through E-03; added a supplemental utility report to the basemap and utility report; revised the Technical Specification section C-103 Water Pollution Control; added clarifying language regarding quantities included in the bid schedule, plans, specifications and contract documents; changed all references to Section P-610 in the L-specifications to Caltrans Section 90; revised the Special Conditions Sections 1.6 Work Schedule and 1.8 Noise; added SBIAA supplemental record drawings and a geotechnical report; and provide clarifications to the proposers’ questions and requests for information.

On August 13, 2026, PFMD consulted with the Purchasing Department and received confirmation that Bogh Construction, LLC (Bogh) should be found non-responsive for failure to provide a Contractor Certification from the California Air Quality Resources Board (CARB) for In-Use Off-Road Diesel Fueled Fleet, Certification of Compliance for the prime contractor and all listed subcontractors, and for listing SBIAA rather than San Bernardino County on the bid bond. On August 14, 2026, PFMD sent an informal email to Bogh advising they provided the lowest price bid but will be found non-responsive for the reasons stated above.

On August 14, 2026, Bogh sent a Bid Response Letter asserting that the $4,263,997 bid was responsive. Griffith Company subsequently filed a bid protest which was received on August 17, 2026, alleging Bogh’s bid was non-responsive for failure to submit required CARB certificates and to name San Bernardino County on the Bid Bond. Following review by PFMD, County Counsel, and the Purchasing Department’s Compliance Division, Griffith Company’s protest was determined to have merit, and Bogh’s bid was found non-responsive due to these material deficiencies. Bogh was provided with an opportunity to respond to the protest, and its response and all related documentation were considered as part of the review. On September 1, 2026, PFMD issued the applicable determination and notification letters, including a Notice of Intent to Award to Griffith Company. PFMD recommends that the Board find Bogh’s bid non-responsive and award the construction contract to Griffith Company as the lowest responsive and responsible bidder.
