Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).  The Children and Families Commission for San Bernardino County (Commission) will reimburse San Bernardino County (County) 100% of the actual cost of services provided on a fee-for-service basis from the Children and Families First Trust Fund.  Adequate appropriation and revenue have been included in the 2026-27 budget and will be included in future recommended budgets.

BACKGROUND INFORMATION

In November 1998, California voters approved Proposition 10, the California Children and Families First Act of 1998 (Act), which imposed a tax on cigarettes and tobacco products and also established the California Children and Families First Commission (CCFFC).  Under this Act, it provides the CCFFC with the authority to adopt guidelines for statewide early childhood development and smoking prevention programs.

As part of the condition of receiving the Act tax proceeds, the County was required to create a County commission.

On January 5, 1999 (Item No. 57), the Board of Supervisors (Board) adopted Ordinance No. 3745 which created and established a County Commission as well as the County Children and Families First Trust Fund for purposes of allocation and appropriation of money resulting from the tax collected from Proposition 10.

The Commission is comprised of seven members, all appointed by the Board, and includes one member of the Board, the Assistant Executive Officer for Human Services, the Director of Public Health or Public Health Officer, and four other members from professions/categories specified in the Ordinance.  The Commission is charged with developing, adopting, promoting, and. implementing local early childhood development programs consistent with the goals of the CCFFC.

On January 12, 1999 (Item No. 34), the Board appointed the initial member of the Board to the Commission.

On March 2, 1999 (Item No. 22), the Board appointed the remaining members of the Commission.

On January 23, 2001 (Item No. 59), the Board approved Agreement No. 01-50 (agreement) between the Commission and the County, effective July 1, 2000, without a contract expiration date (Evergreen Memorandum of Understanding (MOU)).  The agreement allowed the Commission to utilize services provided through the County’s existing infrastructure, with departments (department names and division of duties in 2000 differ from the current departmental structures and duties) including but not limited to: Auditor/Controller-Recorder, County Counsel, County Human Social Services, Employment Management Compensation System, Employee Development, Human Resources, Information Technology Services, Printing/Mail Services/Central Stores, Purchasing, Real Estate Services, and Treasurer/Tax Collector.  The agreement was subsequently amended five times, with the last amendment approved by the Board on May 11, 2010 (Item No. 3), to update language and add services as needed.
