Recommendation
Acting as the governing body of the San Bernardino County Flood Control District, approve Amendment No. 1 to Contract No. 22-628 with L. Curti Truck & Equipment, Inc. for on-call heavy equipment rental services as needed for routine maintenance projects, public projects not exceeding $60,000 pursuant to Public Contracts Code 22032 (a), and emergency projects following the applicable provisions of the Public Contract Code, adding additional requirements in connection with Executive Order N-6-22 Russia Sanctions and Senate Bill 1439 contractor information reporting and increasing the contract amount by $2,500,000 from $2,500,000 to $5,000,000, with no change to the contract term of July 1, 2022 through June 30, 2027.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Fund (Net County Cost). The San Bernardino County Flood Control District (District) is funded by property tax revenue, fee revenue, and other local, state, and federal funding. As this is an on-call heavy equipment rental services contract, the specific projects have not yet been determined. Depending on the project, one of the identified funding sources will be used to fund the cost of the contract. In the event of an emergency, the District will initially finance the emergency costs from their annual budget appropriations. Subsequently, the District will submit reimbursement claims to the California Office of Emergency Management Services, the Federal Highway Administration, and the Federal Emergency Management Agency, as applicable. Sufficient appropriation and revenue are included in the District’s 2023-24 budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
The District may call upon a list of pre-approved vendors to provide on-call heavy equipment rental services. Expenditures for Contract No. 22-628 are reaching the not-to-exceed amount due to L. Curti Truck & Equipment, Inc. being the lowest bidder or responding to emergency projects due to the extreme weather events since September 2022.
The proposed Amendment No.1 will add requirements in connection with Executive Order N-6-22 Russia Sanctions and Senate Bill 1439 contractor information reporting. Amendment No. 1 will also increase the total not-to-exceed amount from $2,500,000 to $5,000,000 for L. Curti Truck & Equipment, Inc. The proposed amendment will allow the District to continue to receive truck hauling services for routine maintenance projects, public projects not exceeding $60,000, and emergency projects (following the applicable provisions of the Public Contract Code).
On June 28, 2022 (Item No. 112), the Board of Supervisors approved contracts with 25 contractors to provide on-call heavy equipment rental services. This item included contracts with L. Curti Truck & Equipment, Inc. in an amount not-to-exceed $2,500,000 from the period of July 1, 2022 through June 30, 2027.
Having a list of contracts available for on-call heavy equipment rental services provides good value to the District and aligns with the County and the Chief Executive Officer’s goals and objectives to provide for the safety of County residents and to operate in a fiscally-responsible and business-like manner.
