RECOMMENDATION(S)
Recommendation
1. Accept award from the United States Department of Justice, Bureau of Justice Assistance for the Fiscal Year 2020 State Criminal Alien Assistance Program in the amount of $677,970, for reimbursement of a portion of the costs to house undocumented criminal aliens in the County’s detention facilities for the period of July 1, 2018 through June 30, 2019.
2. Authorize the Chief Executive Officer to electronically accept the terms and conditions and the “Fiscal Year 2020 Payment Acceptance and Electronic Transfer of Funds” in the amount of $677,970, as required by the Bureau of Justice Assistance Programs.
3. Direct the Chief Executive Officer to transmit any executed documents related to this award to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The Sheriff/Coroner/Public Administrator’s (Department) 2022-23 budget included an estimated revenue of $240,000 for the 2020 State Criminal Alien Assistance Program Award (SCAAP). If necessary, a budget adjustment for the additional revenue in the amount of $437,970 will be included in the Mid-Year Budget Report presented to the Board of Supervisors (Board) for approval.
BACKGROUND INFORMATION
Annually, the United States Department of Justice, Bureau of Justice Assistance makes funds available for the reimbursement of a portion of detention costs associated with the incarceration of undocumented criminal aliens who were in custody for four or more consecutive days and are convicted of a felony or second misdemeanor. SCAAP does not fully reimburse actual costs; instead, data received by all applicants is combined to determine each applicant’s relative percentage share of the total SCAAP allocation.
On March 9, 2021 (Item No. 43), the Board approved an application for the reimbursement of a portion of the costs of justice-involved undocumented criminal aliens housed at the County’s detention facilities for the period of July 1, 2018 through June 30, 2019. The County’s application was successful and SCAAP funding in the amount of $677,970 was awarded on June 23, 2022, resulting in a total of $19.47 million received over the past twenty-two years. Under the terms of the SCAAP, funds awarded must be used for correctional purposes only.
The Chief Executive Officer of the jurisdiction is required to accept the award online within 45 days of the notification and request payment by December 27, 2022. Authorization is requested for the Chief Executive Office to electronically accept the terms and conditions and the “Fiscal Year 2020 Payment Acceptance and Electronic Transfer of Funds”. County Counsel has reviewed the award’s terms and conditions and found no non-standard provisions.
