RECOMMENDATION(S)

Recommendation

1.                     Approve the Grant of Easement for approximately 1,705 square feet [portion of Assessor’s Parcel Number (APN) 0437-182-05] of vacant land for an underground pipeline between the Department of Public Works and Golden State Water Company to convey an easement interest, which will be serving the community of Apple Valley, for a purchase price of $682, plus reimbursement of $5,000 for administrative costs in accordance with Government Code Section 25526.6.

2.                     Authorize the Chairman of the Board of Supervisors to execute the Grant of Easement to convey the easement interest from the Department of Public Works to Golden State Water Company.

3.                     Authorize the Director of the Real Estate Services Department to execute any other documents necessary to complete this transaction.

4.                     Confirm a finding of exemption under the California Environmental Quality Act and direct the Clerk of the Board to post the Notice of Exemption.

FINANCIAL IMPACT

Approval of this item will not result in the use of any Discretionary General Funding (Net County Cost).  The Department of Public Works (County) will receive revenue from this easement interest in the amount of $682, plus reimbursement of $5,000 for administration costs incurred by the County.  County will be relieved of any ongoing maintenance obligations associated with the easement interest on the property.  Sufficient appropriation and revenue is included in the 2020-21 Road Operations budget (6650002000).

 

BACKGROUND INFORMATION

The recommended actions will authorize the conveyance of an easement interest consisting of approximately 1,705 square feet of vacant land (portion of APN 0437-182-05) between the County and Golden State Water Company (GSWC), in the amount of $682, plus reimbursement of $5,000 for administrative costs incurred by the County.

 

GSWC is proposing construction of the Waalew Reservoir north of Sunset Hills Memorial Park and Mortuary in an unincorporated area east of the Town of Apple Valley.  GSWC requires installation of a new eight inch diameter water transmission main pipeline from the Valley Crest Tack and Booster Pumps Station to the proposed reservoir.  Installation of the main water transmission requires a Permit to Enter and Construct (PEC) and permanent pipeline easement across land owned by the County intended for road drainage through undeveloped residential acreage.

 

The transmission main will be constructed between the two reservoirs, crosses the County-owned parcel of land and will be installed underground (below the existing drainage channel) and the preconstruction finished grade elevations and contours will be restored after the main is installed.  There will be no change to the existing drainage patterns as a result of the construction of the transmission main.

 

GSWC continually invests to maintain and improve the local water systems to ensure the delivery of reliable, quality water is not compromised.  This project will improve the distribution system and ensure GSWC can continue providing reliable water service to local customers.  The project includes the installation of an eight inch PVC water main with appurtenances to convey drinking water to a water storage reservoir that will provide fire, emergency, and operational storage to the Apple Valley Community.

 

The County requested that the Real Estate Services Department (RESD) prepare a Grant of Easement to convey an easement interest to Golden State Water Company for an underground pipeline that will cross the County’s property serving the community of the Town of Apple Valley.

 

GSWC, as the lead agency, prepared a mitigated negative declaration for this project pursuant to the provisions of the California Environmental Quality Act.
