Recommendation
Approve Non-financial Memorandum of Understanding (MOU No. 19-00191) with California Correctional Health Care Services for the secure transfer of Personally Identifiable Information/Protected Health Information of patient-inmate medical records for continuity and coordination of care for medical, mental health, dental, and substance use disorder treatment via secure file transfer portal, for the period of November 17, 2020 through June 30, 2022.

FINANCIAL IMPACT
The recommended Memorandum of Understanding (MOU) is non-financial in nature and as such, does not impact Discretionary General Funding (Net County Cost).
BACKGROUND INFORMATION
Pursuant to California Penal Code Section 3003(e)(2), California Correctional Health Care Services (CCHCS) and the County work collaboratively to facilitate the timely and efficient release of patient-inmate medical records for the purpose of ensuring continuity and coordination of care for medical, mental health, dental, and substance use disorder treatment. This collaboration ensures secure transfer of Personally Identifiable Information and Protected Health Information via the CCHCS secure file transfer portal.
The Federal Health Insurance Portability and Accountability Act of 1996 (HIPAA) required the Secretary of the United States Department of Health and Human Services (HSS) to develop regulations protecting the privacy and security of health information. To fulfill this requirement, HSS published the HIPAA Privacy Rule (Standards for Privacy of Individually Identifiable Health Information, established national standards for the protection of certain health information) and the HIPAA Security Rule (Security Standards for the Protection of Electronic Protected Health Information, established a national set of security standards for protecting certain health information that is held or transferred in electronic form). HIPAA requires an MOU between governmental entities with respect to the receipt, access, use, and disclosure of Protected Health Information as defined by Code of Federal Regulations, Title 45, Section 160.103.
