RECOMMENDATION(S)

Recommendation

1.                     Approve Addendum No. 1 to the bid documents, issued on March 2, 2021, for the construction of the Landfill Gas Collection and Control System and Treatment Facility at the Landers Sanitary Landfill.

2.                     Approve Addendum No. 2 to the bid documents, issued on March 10, 2021, for the construction of the Landfill Gas Collection and Control System and Treatment Facility at the Landers Sanitary Landfill.

3.                     Award a construction contract to SCS Field Services, (Long Beach, CA) in the amount of $2,355,863.30 for the construction of the Landfill Gas Collection and Control System and Treatment Facility at the Landers Sanitary Landfill.

4.                     Authorize a contingency fund of $235,586 for the Landfill Gas Collection and Control System Treatment Facility at the Landers Sanitary Landfill.

5.                     Authorize the Director of the Department of Public Works to order any necessary changes or additions in the work being performed under the contract for a total amount not-to-exceed $130,293.17 pursuant to Public Contract Code Section 20142.

6.                     Authorize the Director of the Department of Public Works to accept the work when 100% complete and execute and file the Notice of Completion.

Provide for the Safety, Health and Social Service Needs of County Residents.

 

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as the Department of Public Works - Solid Waste Management Division (SWMD) is financed by fee revenue. SWMD establishes fees that are charged to the public and other agencies for utilization of the County’s Waste Disposal System. The construction contract of $2,355,863.30 and any use of the proposed contingency fund for the construction of the Landfill Gas Collection and Control System and Treatment Facility at the Landers Sanitary Landfill (Project) will be funded by SWMD fee revenue.  Sufficient appropriation and revenue have been included in the SWMD 2020-21 budget and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

The Landers Sanitary Landfill (LSL) is located in the eastern desert of San Bernardino County at 59200 Winters Road, approximately 1.5 miles northeast of the community of Landers. The facility consists of 637 acres of which 92 acres have been designated for disposal. The Project will help  mitigate current and potential future pollutant impacts to the groundwater. The project includes the construction of a permanent landfill gas collection and treatment facility (Facility) consisting of the installation of 21 vertical landfill gas (LFG) extraction wells, condensate and compressed air conveyance piping, pneumatic condensate collection sumps, and a permanent granular activated carbon treatment facility consisting of a concrete pad, perimeter block wall, granular activated carbon and potassium permanganate cannisters, LFG conveyance equipment, and system controls.

 

This Project supports the County and Chief Executive Officer’s goals and objectives of providing for the safety, health and social service needs of County residents by the collection and control of LFG and associated pollutants.

 

Following Board of Supervisors (Board) approval of this item, construction is anticipated to commence in June of 2021 and be completed in the Fall of 2021.

 

PROCUREMENT

The Project was advertised in The Daily Press and Precinct Reporter on February 11 and 18, 2021 and released on the County Electronic Procurement Network (ePro) on February 11, 2021.  A notice inviting bids was also provided to specified construction trade journals as required by Public Contract Code section 22036. A mandatory pre-bid meeting was held on Thursday, February 25, 2021; and was attended by nine firms.

 

There were two addendums issued during the bidding phase, revising the Project plans and specifications as follows:

SWMD has reviewed the bids received and determined that they are responsive; and recommends the Board award the contract to SCS Field Services, the lowest responsible bidder. No appeal/protest letters were received.

 

This Project will have a total contingency fund of $235,586 to compensate the contractor for changes in the contract under certain circumstances.  Under an established formula based on the contract amount, Public Contract Code section 20142 allows the Board to authorize the Director of the Department of Public Works to order changes in the contract, including for unforeseen conditions or design shortfalls, should they become necessary in the future for a total amount not-to-exceed $130,293.17 of the $235,586 contingency fund.
