RECOMMENDATION(S)
Recommendation
1. Reject all bids received on April 21, 2022, for the Santa Ana River Trail Phase III Project in the San Bernardino and Redlands area and find that the rejection of the bids is in the best general interest of the County.
2. Approve the revised plans and specifications for the Santa Ana River Trail Phase III Project in the San Bernardino and Redlands area, as signed and sealed by a registered civil engineer.
3. Authorize the Director of the Department of Public Works to re-advertise the Santa Ana River Trail Phase III Project in the San Bernardino and Redlands area for formal bids.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Santa Ana River Phase III Project in the San Bernardino and Redlands area (Project) is funded by the Transportation Development Act (TDA Article 3, Bicycle/Pedestrian funds) and California Coastal Conservancy Proposition 84 grant funds. Regional Parks (Parks) is responsible for the construction costs, which will be reimbursed through grant funding. Sufficient revenue and appropriation are included in the Parks 2022-23 Budget and will be included in future recommended budgets. Phase III of the Project is contingent upon Parks’ confirmation of additional required funding from the California Coastal Conservancy.
BACKGROUND INFORMATION
The Project consists of a 3.8-mile trail segment on the south side of the Santa Ana River, from Waterman Avenue in the City of San Bernardino to California Street in the City of Redlands and will consist of installing the regional trail to include a bicycle trail, bridges, culverts and access ramps.
On April 21, 2022, the Department of Public Works (Department) received four bids for the Project. The total bid for the apparent low bidder was substantially higher than the Engineer’s Estimate and exceeded the funding available for the Project. The Department is recommending the Board of Supervisors (Board) reject all bids for the Project, approve the revised plans and specifications for the Project to include Federal Disadvantaged Business Enterprise requirements mandated by the new federal funding source, and authorize the Director of the Department to re-advertise the Project for formal bids.
Construction of this segment of the Santa Ana River regional trail system aligns with the County and the Chief Executive Officer’s goals and objectives of ensuring development of a well-planned, balanced, and sustainable County, as well as providing for the safety, health and social service needs of County residents by providing safe and convenient access to locations within the community for pedestrians and cyclists.
PROCUREMENT
The Project will be re-advertised for bids in accordance with Public Contract Code section 22037. In order to attract more competitive bids, the Department will continue to advertise the Project for bids to contractors within and outside of the State. The Department anticipates returning to the Board for an award of the construction contract in September 2022.
