FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). Amendment No.1 (Amendment) to Contract No. 24-177 (Contract) with SmartWAVE Technologies, LLC (SmartWAVE) does not modify the payment terms of the Contract.  The not-to-exceed amount of $5,000,000 remains unchanged during the five-year contract period. County departments will continue to be required to ensure there is adequate appropriation within their respective annual departmental budget for cost incurred during the Contract period. In addition, County departments using the American Rescue Plan Act (ARPA) Coronavirus Local Fiscal Recovery funds for their projects must obligate project costs by issuing their respective Purchase Orders on or before December 31, 2024 and such costs must also be expended on or before December 31, 2026 to become eligible for cost reimbursements.  

 

BACKGROUND INFORMATION

The County’s Innovation and Technology Department (ITD) is responsible for providing a variety of information technology (IT) services to all County departments, special districts, and other federal, state, and local government agencies.  IT services include network connections, such as WiFi, which can be expanded to the public when the public is obtaining services from the County.

 

On February 27, 2024 (Item No. 36), the Board of Supervisors (Board) approved the Contract with SmartWAVE for WiFi installation, support, and maintenance services on an as-needed, fee-for-service basis, in a not-to exceed amount of $5,000,000 for the period of February 27, 2024, through February 26, 2029. The ARPA contract clause was inadvertently omitted from the Contract and as such, the Project & Facilities Management Department (PFMD) is unable to proceed with issuing any Purchase Orders to SmartWAVE under the executed Contract. The ARPA contract clause is required as San Bernardino County may use ARPA funds for some projects requested under the Contract.

 

ITD recommends approval of the Amendment, including ARPA language, to allow County departments to obtain WiFi installation, support, and maintenance services on an as-needed, fee-for-services basis for various WiFi projects at County facilities.
