RECOMMENDATION(S)
Recommendation
1. Approve Addendum No. 1 to the bid documents, issued on August 20, 2019, for the construction of the Unit 2 Phases 3-2 and 4 Groundwater Protection System Composite Liner Construction Project at the San Timoteo Sanitary Landfill (Project).
2. Award a construction contract, in the amount of $ 13,897,887 to Sukut Construction, LLC. (Santa Ana, CA) for the construction of the Project.
3. Authorize a contingency fund of $ 1,389,789 for the Project.
4. Authorize the Director of Public Works to approve the expenditure of the contingency fund of $1,389,789 for verified quantity overruns for this unit priced construction contract.
5. Authorize the Director of Public Works to order any necessary changes or additions in the work being performed under the contract for a total amount not to exceed $210,000 of the contingency fund pursuant to Public Contract Code section 20142.
6. Authorize the Director of Public Works to accept the work when 100% complete and execute and file the Notice of Completion.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost) as the Department of Public Works (Department) - Solid Waste Management Division (SWMD) is financed by fee revenue. SWMD establishes fees that are charged to the public and other agencies for utilization of the County’s Waste Disposal System. Sufficient appropriation is included in the Department’s SWMD 2019-20 budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
The Project at the San Timoteo Sanitary Landfill (STSL) includes the excavation and grading to support the construction of 17 acres of double composite geo-membrane liner, a retention basin, construction of an alternate haul road, a leachate pumping system, and appurtenant infrastructure to supply needed electrical power.
The STSL is located east of the City of Redlands at 31 Refuse Road and has been accepting municipal solid waste from various cities within the County since operations at the site commenced in 1980. The site occupies approximately 366 acres of which 114 are permitted for refuse disposal. The site consists of two waste management units with the Project occupying a portion of the second unit. The current rate of trash disposal at the site necessitates the installation of additional liner to provide the operator with additional capacity. The Unit 2 Phases 3-2 and 4 Liner project consists of approximately 17 acres of single composite geo-membrane liner.
This item supports the County and the Chief Executive Officer’s goals and objectives of providing for the safety, and health needs of County residents by constructing a protective and reliable landfill liner which will prevent adverse effects to the groundwater and environment in nearby communities.
PROCUREMENT
On July 9, 2019 (Item No. 27), the Board of Supervisors (Board) approved the plans and specifications of the Project, and authorized the Director of Public Works to advertise the Project for bids. The Project was released on the County Electronic Procurement Network (ePro) on July 22, 2019 and advertised in the Precinct Reporter and the Daily Sun on July 25, 2019 and August 1, 2019, respectively. A notice inviting bids was also provided to specified construction trade journals as required by Public Contract Code section 22036. A mandatory pre-Bid meeting and job walk was held on Thursday, August 8, 2019 and was attended by 11 firms.

There was a single addendum issued during the bidding phase on August 20, 2019, revising the Project plans and specifications as follows:
• The Bid opening date was extended to August 26, 2019 at 10:00am.
• Revisions to the Bid Schedule.
• Revisions to the Plans and Specifications regarding Stockpile and Liner construction.
• Revision and Clarification of specified working day and liquidated damages.
• Revisions to Specifications pertaining to electrical infrastructure.
• Responses to questions submitted.
The Department has reviewed the bids received and determined that they are responsive and recommends entering into a contract with Sukut Construction, LLC. the lowest responsible bidder. No appeal/protest letters were received.
This Project will allow a total contingency fund of $1,389,789 in order to compensate the contractor for verified quantity overruns for this unit priced construction contract, as well as changes in the contract under certain circumstances. Under an established formula based on the contract amount, Public Contract Code section 20142 allows the Board to authorize the Director of Public Works to order changes in the contract, including unforeseen conditions or design shortfalls, should they become necessary in the future, for a total amount not to exceed $210,000 of the $1,389,789 contingency fund.
