RECOMMENDATION(S)

Recommendation

Acting as the governing body of the San Bernardino County Flood Control District:

1.                     Approve Revenue Agreement with the Riverside County Flood Control and Water Conservation District for the reimbursement of jointly beneficial projects relating to the National Pollutant Discharge Elimination System Municipal Separate Storm Sewer System, in an amount not to exceed $50,000, for the period of September 10, 2024, through March 10, 2025.

2.                     Authorize the Chief Flood Control Engineer, Assistant Director, Deputy Director, or Engineering Manager to execute amendments to the Revenue Agreement to add joint projects, subject to review by County Counsel.

3.                     Direct the Chief Flood Control Engineer to transmit any amendments adding joint projects to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).  The San Bernardino County Flood Control District (District) is funded by property tax revenue, fee revenue, and other local, state, and federal funding. With this Revenue Agreement, the Riverside County Flood Control and Water Conservation District (RCFC & WCD) will reimburse the District for jointly beneficial projects relating to the National Pollutant Discharge Elimination System Municipal Separate Storm Sewer System Permits, including any tentative orders or draft permits. The total amount of payments to the District from RCFC & WCD shall not exceed $50,000. Sufficient appropriation and revenue are included in the District’s 2024-25 budget (1990002552 N10602).

 

BACKGROUND INFORMATION

On March 3, 2024, the Santa Ana Regional Water Quality Control Board (SARWQCB) released the National Pollution Discharge Elimination System (NPDES) Municipal Separate Storm Sewer System (MS4) Tentative Order No. R8-2024-0001 (Tentative Order) for urban stormwater discharges within the Santa Ana River watershed from portions of San Bernardino County, County of Riverside, and County of Orange.  The Tentative Order is regional, regulating urban stormwater discharges from areas within the Santa Ana River watershed of San Bernardino County, County of Riverside, and County of Orange, naming 60 municipal, county, and special district agencies as permittees in the Tentative Order.

The District and RCFC & WCD, the principal permittees of their respective county areas in the Tentative Order, desire to jointly pursue activities, projects, programs, and/or strategies mutually beneficial to the District and RCFC & WCD, such as data analyses support, public education campaigns, permit reporting, and administrative support. The District will be the contracting lead with any future consultant(s) or vendor(s) providing services jointly beneficial to both the District and RCFC & WCD, subject to reimbursement from RCFC & WCD, pursuant to the proposed Revenue Agreement in an amount not to exceed $50,000.

 

The proposed Revenue Agreement will promote the County and the Chief Executive Officer’s goals and objectives by working with other agencies and stakeholders as well as operating in a fiscally-responsible and business-like manner.

 

The District or RCFC & WCD may terminate the Revenue Agreement for convenience following 30 days written notice.
