FINANCIAL IMPACT

Since there is no financial impact to the County from this ordinance, approval of this item will not result in the use of Discretionary General Funding (Net County Cost).

 

BACKGROUND INFORMATION

The proposed ordinance was introduced on September 24, 2019 (Item No. 59).  The recommendation before the Board of Supervisors today is to adopt the ordinance on the Consent Calendar.

 

The subject ordinance amends Section 23.0801 of the County Code to add an exception to the replacement requirement for certain wood shake shingle roofs within areas in the mountain communities that are particularly prone to wildland brush fires (Fire Safety Overlay area).  More specifically, the ordinance provides that roof coverings installed prior to January 1, 2009, with fire retardant treated wood or other organic material with a Class “A” rated assembly under a permit from the County’s Building and Safety Division and supporting documentation showing date of installation, may be accepted subject to inspection and approval by the Fire Chief or designee.  The inspection will also look for adequate defensible space around the structure(s). If inspected and approved by the Fire Chief or designee, the replacement requirement will be held in abeyance 25 years past the final inspection approval date identified in the Building and Safety Division construction permit or when the warranty of the roof has expired, whichever comes first.  The exception achieves a balance between fire protection and hardship to property owners that installed Class “A” wood shake shingle roofs within the Fire Safety Overlay area prior to January 1, 2009 (the original effective date of the ordinance pertaining to compliance with roof covering requirements).    

 

 

This ordinance also makes some clerical changes to Section 23.0801, as well as adds language to emphasize that properties failing to meet the standards identified in this Section shall be deemed noncompliant and, as such, property owners are subject to available enforcement actions identified in Section 11.0201 et seq. of the County Code, including, but not limited to, civil, administrative citation, and/or criminal actions, as well as the recordation of a notice of pendency or a notice of action.
