Recommendation
Acting as the governing body of the San Bernardino County Fire Protection District:
1. Approve Amendment No. 1 to Revenue Agreement No. 21-389 with the City of Highland, to revise various terms regarding the scope of Household Hazardous Waste Collection Program services, add annual inflationary increases ranging from 3.25% to 4.0% to the annual compensation amount of $48,875.56, starting in 2023-24, increase the total compensation by $66,612.93, from $244,377.80 to $310,990.73, and extend the term of the agreement by one year, for a total term of July 1, 2021 through June 30, 2027.
2. Approve Amendment No. 1 to Revenue Agreement No. 21-390 with the City of Needles, to revise various terms regarding the scope of Household Hazardous Waste Collection Program services, add annual inflationary increases ranging from 3.25% to 4.0% to the annual amount of $6,342.74, starting in 2023-24, increase the total compensation by $8,644.58, from $31,713.70 to $40,358.28, and extend the term of the agreement by one year, for a total term of July 1, 2021 through June 30, 2027.

FINANCIAL IMPACT
Approval of these amendments will not result in the use of Discretionary General Funding (Net County Cost). The cities of Highland and Needles will compensate the San Bernardino County Fire Protection District (SBCFPD), Household Hazardous Waste (HHW) Section a total of $351,349.01 over the term of the agreements for the cost of their participation in the HHW Collection Program. Annual compensation amounts include an inflationary increase beginning at 3.25% for 2023-24, and increasing by 0.25% each subsequent year of the agreement through 2026-27. The following table reflects the compensation amount by year for each city.

Appropriation and revenue related to these agreements are included in SBCFPD’s 2022-23 recommended budget and will be included in future recommended budgets.
BACKGROUND INFORMATION
The California Public Resources Code (Section 47000 et seq.) requires cities and counties to provide household hazardous waste collection programs for the safe collection, recycling, treatment, and disposal of hazardous waste generated by households that should be separated from the solid waste stream. San Bernardino County (County), along with the cities/towns within the County, have developed a countywide cooperative program for the collection and management of household hazardous waste and pharmaceutical waste, excluding controlled substances. This program, known as the Household Hazardous Waste Collection Program (HHWCP), is operated by SBCFPD’s HHW Section. SBCFPD contracts with all of the cities and towns within the County, excluding the City of Fontana who operates its own program.
On May 18, 2021 (Item No. 94), the Board of Directors approved Agreement No. 21-389 with the City of Highland and Agreement No. 21-390 with the City of Needles (Agreements) for their participation in the HHWCP. Amendment No. 1 to the Agreements will revise various terms regarding the scope of HHWCP services, including adding universal waste and Home-generated Sharps as part of the household hazardous waste to be collected, aligning costs with SBCFPD’s fee ordinance, and adding annual inflationary increases as identified in the Financial Impact Section. Additionally, the term of the Agreements is extended by one year, for a total term of July 1, 2021 through June 30, 2027.
In accordance with the Agreements, SBCFPD is responsible for managing household hazardous waste generated by the residents of Highland and Needles. SBCFPD is also responsible for providing annual waste reports to the applicable public agency.
