Recommendation

Approve Amendment No. 1 to End User License Agreement No. 22-846 with OnCue Technology, LLC for software used to create, organize, and present evidence for trial, increasing the total contract amount by $43,200, from $9,000 to $52,200, and extending the contract period by four years, for a total contract term of September 13, 2022 through September 12, 2027.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). With an increase of $43,200 for a four-year extension, the total cost of End User License Agreement No. 22-846 (Agreement) will not exceed $52,200. Sufficient appropriation and revenue are included in the County Counsel (Department) 2023-24 budget and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

The OnCue Technology, LLC (OnCue) software is a trial preparation and presentation software that is used to help organize evidence during litigation, present evidence at trial, including creating and editing video, document and exhibit management, and preparing presentations to enhance legal argument.

 

On September 27, 2022 (Item No. 29), the Board of Supervisors approved the Agreement with OnCue for software used to create, organize, and present evidence for trial, in the amount of $9,000 for the period of September 13, 2022 through September 12, 2023.

 

Approval of Amendment No. 1 (Amendment) will extend the Agreement through September 12, 2027, at a cost of $10,800 annually, increase the number of licenses and allow the Department to continue to use this software tool for an additional four years.

 

The Department recommends approval of Amendment with OnCue to continue to reduce the costs of trial preparation by allowing for a more efficient management of evidence in litigation, and thereby contribute to the County’s goal to operate in a fiscally-responsible and business-like manner.

 

PROCUREMENT

On June 15, 2022, the Innovation and Technology Department, at the request of the Department, conducted a Request for Quotation for the software used to create, organize, and present evidence for trial. The following three bids were received:

The three proposers were asked to present a demonstration of their software solution. After the demonstrations, OnCue was selected as the successful bidder based on the software capabilities demonstrated. No protests were received.
