RECOMMENDATION(S)

Recommendation

1.                     Approve Amendment No. 3 to Contract No. 23-287 with Hamburg Bridgeport Consulting LLC for maintenance, support, and new development for the STAR:TNG Case Management System, increasing the contract by $235,000, from $978,120 to $1,213,120, and extending the contract an additional eight months, for a total contract period of October 17, 2022 through June 30, 2026.

2.                     Approve Amendment No. 2 to Contract No. 23-1188 with RCJohnson Consulting LLC for maintenance, support, and new development for the STAR:TNG Case Management System, increasing the contract by $235,000, from $809,120 to $1,044,120, and extending the contract an additional eight months, for a total contract period of May 1, 2023 through June 30, 2026.

3.                     Authorize the Purchasing Agent to issue future change orders up to $10,000, change non-financial/non-material terms, and sign corresponding non-substantive amendments to the contracts referenced in Recommendation Nos. 1 and 2, subject to County Counsel review.

4.                     Direct the District Attorney to transmit any subsequent non-substantive change orders and amendments to the contracts referenced in Recommendation Nos. 1 and 2 to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary Funding (Net County Cost). Amendment No. 3 to Contract No. 23-287 with Hamburg Bridgeport Consulting LLC (Hamburg) increases the contract amount by $235,000 for a total contract cost of $1,213,120. Amendment No. 2 to Contract No. 23-1188 with RCJohnson Consulting LLC (RCJohnson) increases the contract amount by $235,000 for a total contract cost of $1,044,120. Sufficient appropriation has been included in the District Attorney’s (Department) 2025-26 budget and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

The Department is the public prosecutor and has the mandated responsibility to prosecute crimes committed within San Bernardino County (County), including city jurisdictions, pursuant to Government Code 26500. Local law enforcement agencies submit crime reports and investigative information to the Department for review and potential prosecution. The Department submits cases electronically to the Superior Court to start the prosecution process.

 

In Fall 2021, the Department transitioned from its legacy case management system to its new case management system, STAR:TNG. There were four phases, I-IV, during the development and implementation of STAR:TNG, and the Department contracted with Microsoft Corporation (Microsoft) to develop each phase. The Board of Supervisors (Board) approved a purchase order for Phase IV on December 10, 2019 (Item No. 16) and the Purchasing Agent issued Contract No. 4100127030, subsequently assigned Contract No. 19-776, in the amount of $1,922,471.

 

Microsoft did not offer ongoing system maintenance and support for STAR:TNG but did agree to the final Amendment No. 6 to Contract No. 19-776, approved by the Board on June 14, 2022 (Item No. 30). Amendment No. 6 included post-implementation enhancements and system fixes to ensure consistent performance of STAR:TNG during the Department’s planned transition to a new vendor for system maintenance and support. To find the new vendor for maintenance and support, the Department conducted a competitive solicitation in the summer of 2022 prior to the expiration of Amendment No. 6 in December 2022.

 

It was the Department’s intention to avoid gaps in system maintenance and support because the system was new and system bugs were still being addressed.  In addition, staff were still learning how to use STAR:TNG. Therefore, the Purchasing Agent approved Contract No. 4400020623 with Hamburg in October 2022 to fix system bugs that impacted speed or performance and to perform routine system maintenance.

 

Upon completion of the competitive solicitation, the Board awarded Contract No. 22-1176 to dKomplex, Inc. in the amount of $1,410,000 on December 6, 2022 (Item No. 21). In February 2023, dKomplex, Inc. requested, and the County agreed, to terminate Contract No. 22-1176. During this time, the California Racial Justice Act and subsequently Penal Code Section 741 required prosecutors to ensure that charging procedures were free from racial bias and to demonstrate that charges of crime are not influenced by race. Purchasing approved Contract No. 4400021809 with RCJohnson in May 2023 to develop enhancements to STAR:TNG according to operational needs as a result of the legislative requirements.

 

The Department requested Board approval of Amendment No. 1 on April 25, 2023 (Item No. 34) to Contract No. 4400020623 with Hamburg, which was subsequently assigned Contract No. 23-287, and Amendment No. 2 on November 14, 2023 (Item No. 36), for a total contract amount of $978,120. The amendments were needed for enhancements to functionality of STAR:TNG according to changing operational needs as well as continued bug fixes and system support.

 

The Department also requested Board approval of Amendment No. 1 to Contract No. 4400021809 with RCJohnson on November 14, 2023 (Item No. 36), which was subsequently assigned Contract No. 23-1188, for a total contract amount of $809,120 for enhancements to and development of additional functionality of STAR:TNG to be compliant with legislative requirements.

 

The Department has relied on its contracts with Hamburg and RCJohnson for the development and implementation of what is now referred to as a “race-blind charging” process, to be in compliance with the Racial Justice Act. This new procedure is nearly complete. The contracts have also provided needed enhancements, system maintenance, and fixes over the last several years. The Department is now returning its focus on finding a vendor to provide system maintenance, support, and continued development for STAR:TNG to meet operational needs and legislative changes.

 

The Department released Request for Proposal (RFP) DAT125-DA-5870 on June 6, 2025 through the County’s Electronic Procurement Network (ePro) for STAR:TNG maintenance, support, and new development. Although the Department has a number of new initiatives, it must be able to respond quickly to the frequent and ever-changing legislative mandates, public records act requests, and continued need for automated business processes. STAR:TNG is utilized by other County departments and law enforcement agencies to submit crime reports and evidence, outside defense counsel to retrieve case evidence, and allows the department to electronically file cases with the Superior Court. It is imperative that the Department have a consistently performing case management system that contains accurate information.

 

The Department requests approval of the contract amendments with Hamburg and RCJohnson to ensure continued system support during completion of the competitive solicitation and contract award period. The Department also requests authorization to allow the Purchasing Agent to issue change orders up to $10,000 and approve unforeseen minor amendments, such as for a system fix or a minor, but necessary, system enhancement that is outside of the usual scope of work. In addition, if County contract templates change, there could be required changes to contract clauses that need approval. Therefore, the Department requests that Purchasing be given the authority to approve these changes to non-financial/non-material terms. 

 

The Department plans to return to the Board in early 2026 for approval of a new contract for system maintenance and support upon completion of the competitive solicitation if a qualified vendor is found. The amendments will allow continued system maintenance and minimize disruption as the new contract is implemented.

PROCUREMENT

Pursuant to County Policy 11-04, competitive and non-competitive contracts that exceed $200,000 annually must be approved by the Board. Previous amendments to these contracts have been approved by the Board and the requested amendments exceed $200,000. In addition, the request for approval of both amendments is based on the justification of specialized credentials. Hamburg and RCJohnson are former employees of Microsoft who developed STAR:TNG and provided support after the Department implemented the new case management system. They both possess significant knowledge of the Department’s business processes and the importance of system modifications as criminal justice legislation changes.

 

Purchasing concurs with the Department’s request to extend both contracts based on the continued justification of specialized credentials.
