Recommendation
Approve Amendment No. 1 to Revenue Lease Agreement 19-119 with Chaffin and Reeves, Inc. reducing the monthly minimum lease payment from $500 to $300 as a result of the nonoperation of the snack bar building originally included in the concession rights and altering the required days and hours of operation for the Pedal Boat Concession at Yucaipa Regional Park with no change to contract term of April 1, 2019 through March 31, 2020. (Four votes required).

FINANCIAL IMPACT
Approval of this Amendment will not result in the use of additional Discretionary General Funding (Net County Cost). Under this Amendment, the monthly minimum lease fee will be amended from five hundred dollars ($500) or ten percent (10%) of gross income to three hundred dollars ($300) or ten percent (10%) of gross income, whichever is greater.
BACKGROUND INFORMATION
The Regional Parks Department (Department) operates and maintains nine regional parks including Yucaipa Regional Park, located in the city of Yucaipa, and provides for the rental of park property through Board of Supervisors (Board) approved fees. On March 12, 2019 (Item No. 47), the Board approved Agreement No. 19-119 allowing Chaffin and Reeves Inc. (Concessionaire) the rental of the middle lake, docks and the snack bar at Yucaipa Regional Park (Park) from April 1, 2019 through March 31, 2020. Following inclement weather and a subsequent inspection of the snack bar, it was determined by Park staff that the building had incurred significant water damage making it inoperable for the purposes of food storage and preparation.
In July of 2019, the Concessionaire submitted a Concession Management Plan that included the request to reduce the required monthly minimum lease fee due to the reduction in available concession sales and also requested to amend the required hours of operation due to trends in Park attendance.
Approval of this Amendment aligns with the County and Chief Executive Officer Goal and Objective to Operate in a Fiscally-Responsible and Business-Like Manner by allowing the Department to continue its relationship with the Concessionaire, continue supplying Park guests with pedal boat rentals and by operating in a fair and reasonable manner.
PROCUREMENT
Chaffin and Reeves submitted the sole proposal for pedal boat and snack bar concessions at the Park in November of 2018 after a request for solicitations was advertised in the local Sun and Press Enterprise newspapers.
