RECOMMENDATION(S)
Recommendation
1. Acting as the governing body of San Bernardino County:
a. Approve Contract with the City of Fontana to assist with providing enhancements to Southridge Park, to include one shade structure for the playground and two baseball backstops, for the period January 1, 2024, through June 30, 2025, reallocating $350,880 in remaining funds previously awarded under Contract No. 22-90, in the not-to-exceed amount of $370,000, and waive the requirement in County Policy 05-10 for a financial matching contribution of at least 25% from the City of Fontana.
b. Approve Contract with San Bernardino County Fire Protection District to provide funding for the purchase of two drones, in the amount of $110,000, for the contract term of October 8, 2024, through October 7, 2025.
c. Approve Contract with the City of Upland to contribute funding to support a comprehensive Economic Development and Inflation Reduction Project, in the not-to-exceed amount of $350,000, for the period of October 8, 2024, through October 7, 2025.
d. Approve an allocation of $110,000 from the 2024-25 Fourth District’s Board of Supervisors Discretionary Fund - District Specific Priorities Program budget to the San Bernardino County Fire Protection District for the purchase of two drones.
e. Approve an allocation of $9,408 from the 2024-25 Fourth District’s Board of Supervisors Discretionary Fund - District Specific Priorities Program budget to the County Library for the purchase of two-way radios, and waive the requirement in County Policy 05-10 that allocations are for projects or services of $10,000 or more.
f. Authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments, as detailed in the Financial Impact section, to provide funding for the purchase of two drones.
2. Acting as the governing body of San Bernardino County Fire Protection District:
a. Approve Contract with San Bernardino County to receive funding for the purchase of two drones, in the amount of $110,000, for the contract term of October 8, 2024, through October 7, 2025.
b. Authorize the Auditor-Controller/Treasurer/Tax Collector to post budget increases of $110,000, as detailed in the Financial Impact section, to provide funding for the purchase of two drones (Four votes required).

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). On September 21, 2021 (Item No. 18), November 16, 2021 (Item No. 33), February 6, 2024 (Item No. 61), and June 11 (Item No. 110) the Board of Supervisors (Board) approved an allocation of $4 million, $7 million, $6 million, and $3 million respectively, to the Board Discretionary Fund - District Specific Priorities Program (Priorities Program), for each of the five supervisorial districts for projects that meet a public purpose, and provide services to citizens that promote health, safety, economic well-being, and other public services that enhance quality of life and meet the needs of County residents. On an annual basis, unspent appropriations for discretionary funding will be carried over into the subsequent year’s budget.
The Contract referenced in Recommendation No. 1.a. will be funded using reallocated Second District Priorities Program funds originally allocated to Contract No. 22-90, which was approved by the Board on February 8, 2022 (Item No. 30). Recommendations Nos. 1.b., 1.d., 1.e. and 2.a. will be funded by the Fourth District’s Priorities Program budget. Recommendation No. 1.c. will be funded by the Second District’s Priorities Program budget.
The following 2024-25 budget adjustments are needed to proceed with Recommendation Nos. 1.b., 1.d., 1.e., and 2.a.:

BACKGROUND INFORMATION
Priorities Program projects help promote the vision of a complete County by recognizing the unique traits of each Supervisorial District and, thereby, allow individual Board Districts to work with community partners through County services and contractual agreements to identify programs, projects, and initiatives that support the vision, meet a public purpose and provide services to residents that promote health, safety, economic well-being, education, recreation, and other public services that enhance quality of life, and meet the needs of the County’s residents. Projects under the District Specific Priorities Program are based on District Supervisor discretion and are presented by the Chief Executive Officer (CEO) for Board approval.
On February 8, 2022 (Item No. 30), the Board approved Contract No. 22-90 with the City of Fontana for the period February 8, 2022, through December 31, 2022, to provide funding in an amount not-to-exceed $370,000, to assist with providing enhancements to Southridge Park. These enhancements included one shade structure for the playground, four shade structures for the baseball field dugouts, and two baseball backstops. On December 7, 2022, the CEO approved Amendment No. 1 to Contract No. 22-90 to extend the Contract by an additional six months, from December 31, 2022, to June 30, 2023. On June 30, 2023, the CEO approved Amendment No. 2 to Contract No. 22-90 to extend the Contract by an additional six months, from June 30, 2023, to December 31, 2023.
The City of Fontana completed the installation of four shade structures for the baseball field dugouts totaling $19,120 and needs additional time to install the two baseball backstops and one shade structure for the playground using remaining funds in the amount of $350,880.
Approval of Recommendation No. 1.a. will provide a new contract to assist the Second District Supervisor with the public purpose of providing for the health, safety and social service needs of county residents by allowing the City of Fontana additional time to complete all necessary improvements to Southridge Park and will waive the current requirement in County Policy 05-10 for a financial matching contribution of at least 25% because the requirement did not exist when the original Contract No. 22-90 was entered into with the City of Fontana.
Recommendation Nos. 1.b., 1.d. and 2.a. assist the Fourth District Supervisor with the public purpose of providing for the health, public safety and emergency response needs of county residents by providing funding to the San Bernardino County Fire Protection District for the purchase of two long-range electric Vertical Take-Off/Landing fixed wing Unmanned Aerial Surveillance drones. The drones will enhance operations, allow for quicker response to calls in remote or hard to reach areas, and improve coordination among allied agencies during unified command, promoting seamless collaboration and response efficiency. On May 23, 2023 (Item No. 108), the Board approved the addition of new County Policy 03-13, Unmanned Aircraft Systems (UAS) Governance and Usage. Per County Policy 03-13 and 03-13SP1, the UAS Steering Committee approved the purchase and use of these drones at their October 25, 2023, meeting.
Recommendation No. 1.c. will assist the Second District Supervisor in providing funding to the City of Upland to assist with the costs of a comprehensive Economic Development and Inflation Reduction Project (Upland Project). This Upland Project aims to stimulate local economic growth, create job opportunities, reduce the impact of inflation on residents and business, and create new housing and business opportunities in downtown Upland. The Upland Project aligns with the County’s broader objectives to enhance economic resilience and quality of life, along with the public purpose of providing for the health, safety, economic well-being, educational, recreational, and social service needs of county residents.
Recommendation No. 1.e. assists the Fourth District Supervisor with the public purpose of providing for the social service and educational needs of county residents by providing funding to the County Library for the purchase of two-way radios for the Chino Hills, Chino Preserve, Chino, and Montclair libraries located within the Fourth District.
Under the Board Discretionary Fund Priority Program contract terms, the CEO, at the direction of the identified District Supervisor, may extend the term of the recommended contracts in writing, under the following conditions:
a. In aggregate all extensions do not exceed 12 calendar months;
b. Is specifically requested by the contractor;
c. Will not change the project goals or scope of services;
d. Is in the best interest of the County and contractor in performing the scope of services under the contract; and
e. Does not alter the amount of compensation under the contract.
Board discretionary funding allocations under the Priorities Program with community partners must be for projects or services of $10,000 or more as described in County Policy 05-10. Additionally, contracts that include non-profit organizations, government entities, or educational institutions are non-competitive. Contracts with community partners that include for-profit organizations are to be processed according to existing County procurement policies. Contracts with other government agencies or for-profit organizations require a matching contribution of at least 25% of the proposed projects and shall be paid on a lump-sum basis or under other terms as approved by the Board.
