Recommendation

Approve Contract with Colliers Valuation and Advisory Services, LLC, for real estate appraisal services for the Muscoy Area Pedestrian Improvement Project, superseding Purchase Order No. 4100292616, and increasing the total contract amount by $76,865, from $195,000 to a not-to-exceed amount of $271,865, for the period of August 6, 2024, to June 30, 2025, which may be extended for two additional one-year periods by mutual agreement by the parties.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Muscoy Area Pedestrian Improvement Project (Project) will be funded with Gas Tax revenue and funds from the State of California’s Active Transportation Program (ATP). The requested actions are administrative in nature and necessary to increase the total not-to-exceed amount for appraisal services by $76,865, and includes a 10% contingency for potential change order requests.  Sufficient appropriation and revenue have been included in the Department of Public Works (Department) 2024-25 Road Operations budget (6650002000 20H15130).

 

BACKGROUND INFORMATION

The Project is located on Darby Street, Duffy Street, Blake Street, First Avenue, June Street, Second Avenue, and Vermont Street in the Muscoy Area. The Project involves pavement rehabilitation and the installation of pedestrian safety improvements, which include crosswalks, pedestrian flashing beacons, signage, speed feedback signs, sidewalks, and the construction of new or replacement of existing curb ramps at various locations in accordance with current design standards and pursuant to the Americans with Disabilities Act (ADA) guidelines.

 

On March 30, 2023, the Department issued Purchase Order No. 4100292616, in the amount of $195,000. Additional funding up to the amount of $76,865 is now required due to the Project’s design change and subsequent expanded scope of work. According to the terms of the Purchase Order, Colliers Valuation and Advisory Services, LLC (Colliers) will continue to provide real estate right of way appraisal services for the Project. This amount will increase the total not-to-exceed amount from $195,000 to a not-to-exceed amount of $271,865, which is in excess of the Purchasing Agent’s delegated authority of $200,000 set forth by Government Code section 25502.5 and County Code section 14.0115. Approval of this item will approve a contract for appraisal services for the Project, which shall supersede Purchase Order No. 4100292616 and provide for an increased not-to-exceed total amount of $271,865. This includes a contract amount of $247,150, plus a 10% contingency of $24,715 for potential change order requests.

 

On July 12, 2022 (Item No. 32), the Board of Supervisors (Board) determined the Project is exempt under the California Environmental Quality Act (CEQA), approved the Project as defined in the Notice of Exemption, and directed the Clerk of the Board to file and post said notice.

 

On February 10, 2023, a Request for Proposal (RFP) for Real Estate Appraisal Services for the Project was released through the County’s Real Estate Services Department (RESD). By February 22, 2023, five qualified proposals were received and accepted for review.

 

Per a competitive procurement process, Colliers was recommended for the award. On March 30, 2023, the Purchasing Department issued Purchase Order No. 4100292616, in the amount of $195,000.

 

County Policy No. 11-04 requires Board approval for all purchase orders for services that exceed $200,000 in aggregate cost per scope of service, per vendor, per department.

 

The Project aligns with the County and the Chief Executive Officer’s goals and objectives of ensuring the development of a well-planned, balanced and sustainable County by preserving and improving the structural integrity of existing road surfaces and access for pedestrians, including those with disabilities. Through diligent contract negotiations for a fair and reasonable cost, the County is also operating in a fiscally-responsible and business-like manner.
