Recommendation
1. Acting as the governing body of San Bernardino County, approve Side Letter Agreements between San Bernardino County In-Home Supportive Services Public Authority and the Service Employees International Union Local 2015, representing providers in the In-Home Supportive Services Provider Unit, for a Training Side Letter Agreement and a One-Time Payment Side Letter Agreement, effective October 5, 2024, through June 30, 2026.

FINANCIAL IMPACT
This item will not result in the use of Discretionary General Funding (Net County Cost). The underlying Memorandum of Understanding (MOU) between San Bernardino County In-Home Supportive Services Public Authority (IHSS PA) and Service Employees International Union Local 2015 (SEIU) was approved on September 12, 2023 (Item No. 77). The proposed Training Side Letter Agreement and the proposed One-Time Payment Side Letter Agreement (collectively, Agreements) are intended to provide clarifying language. There are no anticipated additional costs associated with the recommended Agreements.
BACKGROUND INFORMATION
On September 12, 2023 (Item No. 77), the Board of Supervisors of San Bernardino County and the Board of Directors of the IHSS PA (Governing Bodies) approved an MOU between IHSS PA and SEIU. The MOU included an annual $50,000 allocation for job specific training classes for In-home Supportive Services (IHSS) providers. The proposed Training Side Letter Agreement clarifies that training materials qualify as “training classes” for the utilization of this allocation.
The Wages article of the MOU included a one-time payment for IHSS providers who met the specified eligibility requirements. The proposed One-Time Payment Side Letter Agreement clarifies that the one-time payment is subject to the availability of American Rescue Plan Act funding. The proposed agreement also establishes an end date of October 31, 2024, for the one-time payment. After this date, pay warrants shall not be issued or reissued.
If approved, the recommended Agreements will be effective October 5, 2024, through June 30, 2026 (the end date of the term for the MOU between IHSS PA and SEIU).
