RECOMMENDATION(S)

Recommendation

1.                     Adopt Resolution urging the California State Legislature and Governor to repeal Sections 57 and 58 of Assembly Bill 130 relating to a Vehicle Miles Traveled mitigation bank and to conduct a study of the potential impacts of imposing a statewide Vehicle Miles Traveled mitigation bank on housing development in San Bernardino County.

2.                     Direct the Deputy Executive Officer for Governmental and Legislative Affairs to transmit copies of the Resolution to the Governor of California, the President Pro Tempore of the California State Senate, the Speaker of the California State Assembly, and the authors of Assembly Bill 130.

Adoption of this Resolution will not result in the use of additional Discretionary General Funding (Net County Cost) as the Resolution is non-financial in nature.

 

BACKGROUND INFORMATION

Assembly Bill (AB) 130 (Statutes of 2025), was enacted as part of the state budget package and signed into law on June 30, 2025.  AB 130 established a statutory California Environmental Quality Act exemption for qualifying urban infill housing projects, or building new housing on vacant land within already developed urban areas, and included Sections 57 and 58, which established a statewide Vehicle Miles Traveled (VMT) mitigation bank to be imposed on new residential developments, with the intent to reduce VMT and address the state’s climate goals.

 

The State already has robust efforts to reduce greenhouse gas emissions. Adding a VMT mitigation bank could increase the cost of new housing construction in the county that is already facing affordability issues; potentially discourage new housing development by imposing new and potentially significant costs on residential development and deter new housing construction and impact shelter for individuals and families; and potentially affect prospective homeowners and renters by adding more housing costs and decreasing housing supplies. Recommendation No.1 would request the repeal of Sections 57 and 58 of AB 130 and urge the State Legislature to conduct a study of the potential impacts of a statewide VMT mitigation bank on housing development in San Bernardino County.

 

Under Recommendation No. 2, the Deputy Executive Officer for Governmental and Legislative Affairs would transmit copies of the resolution to the Governor of California, the President Pro Tempore of the California State Senate, the Speaker of the California State Assembly, and the authors of AB 130.
