RECOMMENDATION(S)
Recommendation
1. Accept a grant award (Award No. 15PBJA-24-GG-05317-JAGX) from the United States Department of Justice, Office of Justice Programs, Bureau of Justice Assistance, under the 2024 Edward Byrne Memorial Justice Assistance Grant Program, in the amount of $310,538, for the period of October 1, 2023 through September 30, 2027.
2. Authorize the County Chief Financial Officer, the Chair of the Law and Justice Group, or the assigned grant administrator, as required by the Edward Byrne Memorial Justice Assistance Grant Program, to electronically submit all documents and forms required for acceptance and administration of the grant.
3. Approve grant sub-award Agreement, as required by the Edward Byrne Memorial Justice Assistance Grant Program, with the City of San Bernardino, for the period of October 1, 2023 through September 30, 2027 for $181,099.
4. Authorize the Chair of the Law and Justice Group to execute the grant sub-award Agreement with the City of San Bernardino referenced in Recommendation No. 3, and any other non-substantive amendments, for the 2024 Edward Byrne Memorial Justice Assistance Grant Program, for the period of October 1, 2023 through September 30, 2027.
5. Direct the County Chief Financial Officer, the Chair of the Law and Justice Group, or the assigned grant administrator to transmit the grant award Agreement, the grant sub-award Agreement and any non-substantive amendments to the Clerk of the Board of Supervisors within 30 days of execution.
6. Authorize the Auditor-Controller/Treasurer/Tax Collector to post the adjustments to the Law and Justice Group 2024-25 budget as detailed in the Financial Impact section (Four votes required).

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). No matching funds are required for the 2024 Edward Byrne Memorial Justice Assistance Grant Program (interest-earning Fund 2363). San Bernardino County (County) will pass through $181,099 to the City of San Bernardino (City). The County will retain a total of $129,439 ($113,912 for specific County projects and $15,527 for grant administration). The Law and Justice Group (L&JG) requests the Auditor-Controller/Treasurer/Tax Collector post the necessary adjustments to the 2024-25 budget.

BACKGROUND INFORMATION
The United States Department of Justice (DOJ), Office of Justice Programs, Bureau of Justice Assistance announce the availability of grant funds to state and local units of government through the Edward Byrne Memorial Justice Assistance Grant Program (JAG) Program annually. San Bernardino County has participated in the JAG Program since 2005. This program provides funding to state and local governments for support of a broad range of activities intended to prevent and control crime and improve the criminal justice system. Distribution of funds by the federal government is calculated using a formula, which considers both population and crime statistics. Awards are subject to the availability of appropriated funds.
On October 22, 2024 (Item No. 26), the Board of Supervisors approved the submission of a grant application to DOJ in the amount of $310,538 for the 2024 Edward Byrne Memorial Justice Assistance Grant Program. Pursuant to the grant application requirements, the County will enter into a Memorandum of Understanding (MOU) with the City of San Bernardino to share the JAG 2024 grant. When the MOU is executed, the County will release pass-through funds to the City. The MOU also designates the County to serve as the applicant/fiscal agent for the administration of the joint funds. A five percent administrative fee will be retained by the County for use by L&JG to fund administrative costs over the four-year grant term.
The JAG Program further requires participating jurisdictions receiving grant funds to execute grant sub-award agreements in order to acknowledge receipt of the federal award information and applicable compliance requirements, including special conditions for each sub-award. By entering into a grant sub-award agreement, the participating entity agrees to undertake and carry out activities delineated by the grant award, and to the conditions or limitations set forth in the grant award.
Delegation of authority is requested for the L&JG Chair to execute the sub-award agreement for the grant, and for the County Chief Financial Officer, the L&JG Chair, or the assigned grant administrator to electronically submit all documents and forms required for acceptance and administration of the JAG 2024 grant, as required by the JAG Program.
The L&JG received notification of the JAG 2024 grant award on December 5, 2024 and it is being presented to the Board for acceptance at the earliest available meeting after completion of the required financial and legal reviews.
