RECOMMENDATION(S)

Recommendation

Acting as the governing body of the San Bernardino County Flood Control District:

1.                     Award a contract to Horizons Construction Co. Int’l, Inc. (Orange, CA) in the amount of $798,481 for the Rialto Channel Trail Fence and Rock Installation Project in the City of Rialto.

2.                     Authorize a contingency fund of $79,848 for the Rialto Channel Trail Fence and Rock Installation Project in the City of Rialto.

3.                     Authorize the Chief Flood Control Engineer of the San Bernardino County Flood Control District to approve the expenditure of the contingency fund of $79,848 for verified quantity overruns for this unit priced construction contract.

4.                     Authorize the Chief Flood Control Engineer of the San Bernardino County Flood Control District to order any necessary changes or additions in the work being performed under the contract for a total amount not-to-exceed $52,424 of the $79,848 contingency fund, pursuant to Public Contract Code section 21061(d).

5.                     Authorize the Chief Flood Control Engineer of the San Bernardino County Flood Control District to accept the work when 100% complete and execute and file the Notice of Completion.

6.                     Authorize the Auditor-Controller/Treasurer/Tax Collector to post budget adjustments in the amount of $900,000, as detailed in the Financial Impact section, for the Rialto Channel Trail Fence and Rock Installation Project in the City of Rialto (Four votes required).

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The San Bernardino County Flood Control District (District) is funded by property tax revenue, fee revenue, and other local, state, and federal funding. The Rialto Channel Trail Fence and Rock Installation Project in the City of Rialto (Project) will be funded by property tax revenue currently held in available reserves. The following 2023-24 budget adjustments are requested for the Project:

BACKGROUND INFORMATION

The Project consists of installing approximately 1.4 miles of trail fence, which will be white polyvinyl chloride (PVC) ranch style fencing, and 3/4" decorative rock along the eight-foot parkway adjacent to the existing pedestrian/bicycle trail. The Project is located along Cactus Avenue in the City of Rialto (City), between Rialto Avenue and Baseline Road.

 

The trail fence installation and rock placement are part of the Cactus Trail Improvement Project in the City, consisting of an existing concrete pedestrian/bicycle trail. The trail fence will be installed on center within the eight-foot parkway, beginning near Rialto Avenue to Baseline Road. The parkway is bounded by the pedestrian/bicycle walkway to the west and by Cactus Avenue to the east.

 

On May 23, 2023 (Item No. 99), the Board of Supervisors (Board) approved the Project and the Project plans and specifications as well as adopted Resolution No. 2023-75 making responsible agency findings pursuant to the California Environmental Quality Act. The Clerk of the Board filed the Notice of Determination on May 24, 2023; no timely challenge was filed.

 

Following Board approval of this item, construction is anticipated to commence in August 2023 and be completed by the end of September 2023.

 

PROCUREMENT

On May 23, 2023 (Item No. 99), the Board authorized the Chief Flood Control Engineer of the District to advertise the Project for bids. This Project was advertised in the Daily Press newspaper on June 7, 2023, in the Precinct Reporter on June 9, 2023, and released on the County Electronic Procurement Network (ePro) on June 7, 2023. Notice inviting bids was also provided to specified construction trade journals as required by Public Contract Code section 22036. On July 6, 2023, the following three bids were received:

The District reviewed the bids received and determined that all are responsive and recommends that the Board award the contract to Horizons Construction Co. Int’l, Inc., the lowest responsive bidder. No appeal/protest letters were received.

 

This Project will have a 10 percent contingency fund of $79,848 to compensate the contractor for verified quantity overruns, as well as changes in the contract under certain circumstances.  Under an established formula based on the contract amount, Public Contract Code section 21061(d) allows the Board to authorize the Chief Flood Control Engineer to order changes in the contract, including for unforeseen conditions or design shortfalls, should they become necessary in the future, for a total amount not to exceed $52,424 of the $79,848 contingency fund.
