Approve Amendment No. 4 to Grant Revenue Agreement No. 15-009 (County Agreement No. 15-579) with the California Coastal Conservancy extending the completion date from December 30, 2020 to February 28, 2025 for Phase III of the Santa Ana River Trail.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). There is no matching requirement from the Regional Parks Department. The amendment, as proposed by the California Coastal Conservancy (Conservancy) provides for an extension to the required completion date to February 28, 2025 for the construction of a 3.8 mile segment of the Santa Ana River Trail (Phase III) from Waterman Avenue in the City of San Bernardino to California Street in the City of Redlands for an amount not to exceed $3,909,425.
Adequate appropriation and revenue have been included in the Regional Parks Department’s 2020-21 budget for construction of Phase III and will be included in future recommended budgets for design and mitigation.
BACKGROUND INFORMATION
In 2006, California voters passed the Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Act of 2006 (Proposition 84). This act authorized $45 million in general obligation bonds for the entire Santa Ana River Trail (which crosses through three counties). The Conservancy was authorized by the California State Natural Resources Agency to administer these funds.
On August 25, 2015 (Item No. 50), the Board of Supervisors (Board) approved State Agreement No. 15-009 (Agreement) in the amount of $3,399,500 for the construction of a 3.8 mile segment of the Santa Ana River Parkway Trail corridor from Waterman Avenue, in the City of San Bernardino, to California Street, in the City of Redlands with a required completion date of September 30, 2017. The Board also adopted a resolution authorizing the Chief Executive Officer or the Director of Regional Parks to execute all documents in relation to the acceptance and implementation of the agreement and any subsequent non-substantive amendments, as required by the State on behalf of the County.
On September 12, 2017 (Item No. 62), the Board approved Amendment No. 1 to the Agreement which extended the project completion date from September 30, 2017 to September 30, 2018.
On October 2, 2018 (Item No. 19), the Board approved Amendment No. 2 to the Agreement extending the project completion date from September 30, 2018 to December 30, 2020.
On November 19, 2019 (Item No. 31), the Board approved Amendment No. 3 to the Agreement, increasing it by $509,925 for a new total of $3,909,425.
Construction timelines have been extended due to the Regional Parks Department (Department) previously not having funding to cover mitigation costs. The Department received notification in April 2021 that grant funding for mitigation was approved by Caltrans Active Transportation Program, allowing for the construction to commence in April 2022. Approval of this Item will extend the construction deadline to February 28, 2025. The County is presented with the agreement to sign first and then the State will sign thus constituting the contract “Effective Date”. Amendment No. 4 to the agreement is effective when signed by both parties and received in the Office of the Conservancy. The Department will notify the County Administrative Office once the amended agreement has been executed by the Conservancy.
Approval of this Amendment aligns with County and Chief Executive Officer Goals and Objectives by allowing the Regional Parks Department to collaborate directly with local governments and to assist with the continued development of the Santa Ana River Trail.
