RECOMMENDATION(S)
Recommendation
1. Acting as the governing body of the County of San Bernardino, approve Amendment No. 3 to Agreement No. 18-760 between the County of San Bernardino, Bloomington Park Developer, LLC, and the Bloomington Recreation and Park District, extending the term of the contract from July 1, 2021 to March 13, 2022, for a total contract term of October 16, 2018 to March 13, 2022, with no change to the contract amount, for the completion of the Ayala Park Relocation Project.
2. Acting as the governing body of Bloomington Recreation and Park District, approve Amendment No. 3 to Agreement No. 18-760 between the County of San Bernardino, Bloomington Park Developer, LLC, and the Bloomington Recreation and Park District, extending the term of the contract from July 1, 2021 to March 13, 2022, for a total contract term of October 16, 2018 to March 13, 2022, with no change to the contract amount, for the completion of the Ayala Park Relocation Project.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). There is no financial impact from this action as Amendment No. 3 extends the term of the contract with no change to the contract amount.
BACKGROUND INFORMATION
As part of its vision to revitalize unincorporated areas of the County of San Bernardino (County), the Board of Supervisors (Board) identified the community of Bloomington as an investment and revitalization opportunity. Revitalization efforts for Bloomington included adoption of the Valley Corridor Specific Plan (VCSP). The VCSP encourages opportunities for healthier living, including pedestrian-oriented activity centers that highlight Bloomington's cultural, historical, and community assets. To further the VCSP vision, the County designed the third phase of the Bloomington Affordable Housing Development. This phase includes relocation and construction of Ayala Park (Project).
On January 23, 2018 (Item No. 40), the Board approved the purchase of property at 17909 Marygold Avenue in Bloomington for the new Ayala Park location.
On October 16, 2018 (Item No. 22), the Board approved Development Services Agreement (Agreement No. 18-760) between Bloomington Park Developer, LLC (Developer) and the County of San Bernardino (County) for the Developer to provide design and land use approvals for the Project. The amount of the agreement for these services was $635,000.
On December 10, 2019 (Item No. 53), the Board approved Amendment No. 1 to Agreement No. 18-760 that increased the contract amount by $4,745,000 (from $635,000 to $5,380,000), which allowed Developer to proceed with construction of the Project. Amendment No. 1 also added the Bloomington Recreation and Park District as a signatory to the agreement.
On November 17, 2020 (Item No. 93), the Board approved Amendment No. 2 to Agreement No. 18-760 that increased the contract amount by $710,000 (from $5,380,000 to $6,090,000) for additional development services in relation to the Project.
Due to the COVID-19 pandemic, the Developer experienced a delay from the manufacturer of needed material that caused the Project’s construction delivery schedule to also be delayed. As a result, approval of this item (Amendment No. 3) is requested to extend the contract term from July 1, 2021 to March 13, 2022. This will provide the Developer with additional time to complete construction of the Project. The March 13, 2022 date aligns with the timeframe of tax credits received by the Developer on the adjacent Housing and Community Center project. There is no increase in the contract amount from this amendment.
