RECOMMENDATION(S)

Recommendation

1.                     Approve Grant Agreement with the State of California - Office of Traffic Safety, Intensive Probation Supervision for High-Risk Felony and Repeat DUI-Offenders (State Grant No. AL24019) for the High-Risk Drunk Driving Supervision Program, in the amount of $645,000 for the period of October 1, 2023 through September 30, 2024.

2.                     Authorize the Chief Probation Officer to electronically sign and submit the Grant Agreement, all subsequent quarterly performance reports and any subsequent non-substantive amendments to the State of California - Office of Traffic Safety, Intensive Probation Supervision for High-Risk Felony and Repeat DUI-Offenders for the High-Risk Drunk Driving Supervision Program, subject to review by County Counsel.

3.                     Direct the Chief Probation Officer to transmit the Grant Agreement and all subsequent non-substantive amendments to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). Approval of the Grant Agreement will provide $645,000 to fund four existing Probation Officers, training costs and activities. If future grant funding is reduced, the Probation Department (Department) will transition staff to other units and fund the positions. No matching funds are required. Sufficient appropriation and revenue have been included in the Department’s 2023-24 budget and will be included in the 2024-25 recommended budget.

 

BACKGROUND INFORMATION

State of California - Office of Traffic Safety (OTS) provides funding to local law enforcement agencies to increase traffic safety through County programs and activities. The grant award will provide funds for four Probation Officers assigned to the High-Risk Drunk Driving Supervision Program (Program), which supports the goal of reducing drinking and driving by providing 90 days of intensive supervision. The Program includes provision of random alcohol monitoring, treatment and counseling to high-risk felony and repeat offenders during office visits and field visits. The Probation Officers also participate in local law enforcement anti-DUI efforts.  The Program also, aligns with the Countywide goal to provide for the safety, health, and social service needs of County residents by supporting these individuals in behavioral changes and reducing incidents of driving under the influence.

 

Grant funding has been received on an ongoing basis since initiation of the Program by the County in 2006, and was most recently approved by the Board of Supervisors on September 13, 2022 (Item No. 41). Since 2006, the Department has successfully provided effective supervision to more than 1,400 felony probationers at the highest risk of recidivating or continuing to drive under the influence of alcohol. The Program helps reduce the number of Driving Under the Influence (DUI) arrests and sends a unified message to the community that drunk driving will be targeted.

 

County Policy 05-13 requires approval by the Chief Executive Officer (CEO) for application of grants, and on January 30, 2023, the CEO approved the Department’s grant application for 2023-24; the Department submitted the grant application to OTS on the same day. On August 23, 2023, the Department’s application was approved, and is being submitted to the Board of Supervisors for approval at the first available meeting date after completion of the operational, financial, and legal review process.

 

OTS requires the individual who signs the Grant Agreement to also sign any subsequent reports or report revisions. Approval of this item authorizes the Chief Probation Officer to electronically sign and submit the Grant Agreement, all subsequent quarterly performance reports, and any subsequent non-substantive amendments, subject to review by County Counsel.  Approval of this item also directs the Chief Probation Officer to transmit the Grant Agreement and all amendments to the Clerk of the Board of Supervisors within 30 days of execution.
