Recommendation
Approve Amendment No. 3 to non-financial Joint Powers Agreement No. 05-279, Inland Empire Health Plan Health Access Joint Powers Agreement, between San Bernardino County and the County of Riverside in order to provide health care services for eligible persons and make revisions to some duties and appointment of officers.

FINANCIAL IMPACT
Approval of Amendment No. 3 to Agreement No. 05-279 (Agreement) will not result in the use of Discretionary General Funding (Net County Cost) as the recommended amendment is non-financial in nature.
BACKGROUND INFORMATION
The Inland Empire Health Plan (IEHP) provides the health plan administration for the members enrolled in the Medi-Cal managed care plan as legislated by the State. On May 3, 2005 (Item No. 76), the Board of Supervisors (Board) approved the Agreement between San Bernardino County and the County of Riverside, and the counties formed the IEHP Health Access, a joint powers authority, to service the non-Medi-Cal membership of IEHP. The Governing Board of IEHP also serves as the Governing Board for the IEHP Health Access.
Amendment No. 3 to the Agreement will allow the IEHP Health Access to provide enhanced care management services to IEHP members. Enhanced care management services are a Medi-Cal benefit that provides comprehensive care management and coordinates health care related services to eligible members who have complex needs. The Amendment states that Controller books and records of IEHP are open to inspection during normal business hours by regulatory agencies and that the governing board of the IEHP Health Access may appoint and employ a Chief Executive Officer. The Amendment further states that if the IEHP Health Access contracts for administrative services with IEHP then the offices of Treasurer and Controller may be held by the Chief Financial Officer of IEHP.
On May 24, 2016 (Item No. 63), the Board approved Amendment No. 1 to the Agreement to update titles and roles of key management staff and to clarify language, including language regarding the powers of the parties to establish advisory bodies and committees.
On June 23, 2020 (Item No. 40), the Board approved Amendment No. 2 to the Agreement to change from a fiscal year to a calendar year for financial reporting.
