Approve Revenue Contract with the Colton Joint Unified School District for the Sheriff/Coroner/Public Administrator to provide School Resource Officer services, in the total amount of $469,177, for the period of July 1, 2021 through June 30, 2022.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The proposed contract provides revenue in the amount of $469,177 to fund two existing Deputy Sheriff positions to serve as School Resource Officers (SRO) for the 2021-22 school year. The rates listed in Schedule A  include 73% of the annual cost of a Deputy Sheriff and marked patrol units assigned to the Colton Joint Unified School District (CJUSD), and provide full cost recovery of both the direct and indirect costs of providing services. This equates to 190 days of service, consistent with the length of the school year (180 days of student instruction), plus 10 additional days for any necessary services such as in-service training, meetings, and report writing. Sufficient appropriation and revenue are included in the Sheriff/Coroner/Public Administrator’s (Department) 2021-22 recommended budget.

 

BACKGROUND INFORMATION

On June 23, 2015 (Item No. 82), the Board of Supervisors approved Contract No. 15-499 with CJUSD, for SRO services at both Bloomington and Grand Terrace High Schools, and also approved subsequent annual amendments to the contract with the most recent being Amendment No. 5 (on June 23, 2020; Item No. 82) that extended SRO services through June 30, 2021.

 

The proposed contract will provide for the continuation of SRO services for the CJUSD. The SROs work closely with school administrators to create a safe environment for both students and staff. In addition to peace officer duties, SROs provide mentoring to students and conduct presentations on youth-related issues. This contract is beneficial to both CJUSD and the Department by having a dedicated law enforcement presence on campus and alleviating the need for patrol deputies to respond to campus issues.

 

The contract with CJUSD contains terms and conditions that differ from the standard County contract, including but not limited to the following:

 

1.                     Indemnification

                     The County standard contract requires the Contractor to indemnify the County in accordance with County Policy 11-07.

                     The contract with CJUSD allows for mutual indemnification.

                     Potential Impact: The agreement will require the County and CJUSD to indemnify each other based on comparative fault. The County could be liable for potential harm or loss incurred by CJUSD.

 

While this is a notable exception to the County’s standard contract language, the Department recommends approval of this contract to pursue the County and Chief Executive Officer’s goals and objectives by working with other agencies and to provide for the safety, health and social service needs of County residents. County Counsel and Risk Management have reviewed and provided input on the proposed contract with CJUSD.
