RECOMMENDATION(S)
Recommendation
1. Approve Amendment No. 1 to Agreement No. 19-308 (State Agreement No. VC-9075-A1) with the California Victim Compensation Board for the Criminal Restitution program to receive additional grant funding in the amount of $145,586, increasing the total from $436,758 to $582,344, and extend the term by one year, for a total term of July 1, 2019 through June 30, 2023.
2. Adopt Resolution authorizing the District Attorney to sign and submit the agreement amendment on behalf of the Board of Supervisors, including any subsequent non-substantive amendments, as required by the California Victim Compensation Board, subject to review by County Counsel.
3. Direct the District Attorney to transmit all documents in relation to this agreement to the Clerk of the Board of Supervisors within 30 days of execution.

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The additional grant funds of $145,586 from the California Victim Compensation Board (CalVCB) will be distributed to the District Attorney’s Office (Department) during 2022-23. This is in addition to the original agreement for grant funds of $436,758 from CalVCB distributed to the Department in the amount of $145,586 annually for three years beginning 2019-20. This revenue will be used to help fund staff assigned to the Department’s criminal restitution program, including 1 Restitution Specialist (Paralegal) and 1 Office Assistant III. Appropriation and revenue related to this item will be included in the Department’s 2022-23 recommended budget.
BACKGROUND INFORMATION
In 1997, CalVCB implemented a restitution program to increase imposition of statutorily mandated restitution fines and restitution orders in criminal cases. This program was established to ensure there would be funding available state-wide to assist victims of crime. San Bernardino County has been receiving funding under this program for the last 25 years.
On May 21, 2019 (Item No. 56) the Board of Supervisors approved Agreement No. 19-308 with California Victim Compensation Board to receive grant funding in the amount of $436,758 for the Criminal Restitution program from July 1, 2019 through June 30, 2022.
The recommended agreement amendment with CalVCB will allow the Department to receive an allocation of funding for the County’s criminal restitution program for an additional year. Specifically, these funds will be used by the Department to offset the projected cost of staff assigned to educate criminal justice personnel regarding restitution requirements of the California Constitution and California Penal Code. The restitution staff coordinates with Deputy District Attorneys, Probation Officers, law enforcement agencies, court personnel, etc. and provides information necessary to ensure proper restitution fines/orders are imposed in accordance with applicable statutes.
