Recommendation
Acting as the governing body of the San Bernardino County Flood Control District:
1. Adopt Resolution, as required by the California Governor's Office of Emergency Services, to designate certain San Bernardino County Flood Control District staff to represent the San Bernardino County Flood Control District, up to three years following the date of execution, on matters pertaining to Federal and State Disaster Reimbursement Claims under Public Law 93-288, as amended by the Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1988, State financial assistance under the California Disaster Assistance Act, and/or Section 1366 of the National Flood Insurance Act of 1968.
2. Authorize the Chief Flood Control Engineer, Assistant Director - Flood Control, Deputy Director - Project Planning, Deputy Director - Operations, or Chief of Flood Control Planning/Water Resources Division to execute and file all necessary Federal and State Disaster Reimbursement Claims documentation with the California Governor's Office of Emergency Services, for the purpose of obtaining certain financial assistance.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The San Bernardino County Flood Control District (District) is funded by property tax revenue, fee revenue and other local, state, and federal funding. The action to adopt the proposed Resolution is administrative in nature and has minimal financial impact to the District. Sufficient appropriation is included in the District’s 2024-25 budget.
BACKGROUND INFORMATION
The District must designate authorized representatives as Applicant's Agents to administer applications, claims, reimbursements advancements, and related documents with the California Governor's Office of Emergency Services (Cal OES) for the purpose of obtaining certain Federal financial assistance under Public Law 93-288 as amended by the Robert T. Stafford Disaster Relief and Emergency Assistance Act of 1988, and/or State financial assistance under the California Disaster Assistance Act. Under current Cal OES policy, a new resolution is required every three years. Should the District be eligible for Federal and/or State disaster assistance during the term covered by the recommended Resolution, the District will comply with all applicable laws and County policies pertaining to procurement, contracting, and grants, seeking Board of Supervisors (Board) approval when required.
On March 15, 2022 (Item No. 59), the Board of Supervisors (Board) adopted Resolution No. 2022-51, effective for three years, authorizing the Chief Flood Control Engineer, Assistant Director - Flood Control, Deputy Director - Flood Control, Deputy Director - Operations, Chief of Flood Control Planning/Water Resources Division, or Chief of Permits/Operations Support Division Operations to execute and file all necessary Federal and State Disaster Reimbursement Claims on behalf of the District with the State of California Emergency Management Agency, now known as Cal OES, and the United States Department of Homeland Security, Federal Emergency Management Agency.
Adoption of this Resolution meets the County and the Chief Executive Officer's goals and objectives of working collaboratively with other agencies and stakeholders in order to provide for the safety and health of the public.
