Recommendation

Approve Amendment No. 1 to Memorandum of Understanding No. 24-30 with the City of Chino for the extension of plan check, inspection, and ministerial permit issuance services to include approved annexation area, LAFCO 3268, consisting of approximately 57.6 acres, with no change to the service period of January 9, 2024, through January 8, 2029.

FINANCIAL IMPACT

Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). All costs of processing plan check, inspection, and ministerial permit issuance services are to be paid by the applicant of the development projects, based on the County’s applicable fees codified in the County Code section 16.0201 et seq. Sufficient appropriation and revenue to complete this amendment have been included in the Land Use Services Department, Planning Division 2024-25 budget.

 

BACKGROUND INFORMATION

On January 9, 2024 (Item No. 25), the Board of Supervisors (Board) approved a Memorandum of Understanding (MOU) with the City of Chino (City) for plan check, inspection and ministerial permit issuance services (Services) related to the Yorba Villas Project and other development projects located within a future annexation area consisting of approximately 145 acres.

 

On July 17, 2024, the San Bernardino Local Agency Formation Commission (LAFCO) approved LAFCO 3268 for the detachment of County Service Area 70 and annexation of approximately 57.6 acres to the City, generally bounded by a combination of the San Bernardino Countyline, the San Antonio Creek Channel, and parcel lines on the west; Francis Avenue on the north; East End Avenue (portion of existing City boundary) on the east; and a combination of Philadelphia Street and parcel lines (existing City boundary) on the south, within the City’s sphere of influence (East End Annexation Area).

 

On September 18, 2024, LAFCO approved annexation LAFCO 3269 for the detachment of County Service Area 70 for annexation of the approximately 144 acres covered by the MOU to the City, generally located north and south of Francis Avenue between Norton and Yorba Avenues (Ramona Annexation Area). The Ramona Annexation Area is bounded by: parcel on the north; a combination of Francis Avenue, Ramona Avenue, and parcel lines (generally City boundaries) on the west; a combination of Philadelphia Street and parcel lines (City boundaries) on the south; and a combination of Yorba Avenue and parcel lines (generally City boundaries) on the east. This annexation also includes the Yorba Villas Project.

 

Due to the additional annexation of LAFCO 3268 covering the East End Annexation Area, and to allow for consistency following the approved annexations, Amendment No. 1 to the MOU with the City provides for the County to expand the Services to both the East End Annexation Area and Ramona Annexation Area, including the Yorba Villas Project, and other development projects within these areas. The Services will be performed in accordance with applicable County regulations.

 

The Land Use Services Department recommends the Board approve Amendment No. 1 to the MOU because it will expand the previously agreed upon Services to the East End Annexation Area and ensure property owners within the formerly unincorporated areas will continue to receive County Services for development consistency following annexation.
