RECOMMENDATION(S)

Recommendation

Approve Amendment No. 2 to Employment Contract No. 22-854 with Peter J. Rogers, to continue to provide support services to the Fourth District Supervisor as a Deputy Chief of Staff, increasing the salary range, retroactively effective November 30, 2024, for an estimated annual cost of $163,723 (Salary - $126,454, Benefits $37,269).

FINANCIAL IMPACT

Approval of this contract will not require the use of additional Discretionary General Funding (Net County Cost). Sufficient appropriation exists within the Fourth District’s 2024-25 budget to fund the costs related to this employment contract and will be included in future recommended budgets.

 

BACKGROUND INFORMATION

Staff services to members of the Board of Supervisors (Board) are provided through contractual arrangement, as required by the County Charter.

 

On February 14, 2017 (Item No. 99), the Board approved Employment Contract No. 17-68 with Peter J. Rogers to provide services as a District Director. On September 27, 2022 (Item No. 3), the Board approved Employment Contract No. 22-854 to engage Peter J. Rogers as a Deputy Chief of Staff. On June 13, 2023 (Item No. 4), the Board approved Amendment No. 1 to Employment Contract No. 22-854, updating benefits to add the dental premium subsidy, effective June 17, 2023.

 

South Coast Air Quality Management District (SCAQMD) is the air pollution control agency for all of Orange County and the urban portions of Los Angeles, Riverside and San Bernardino counties. SCAQMD is governed by a 13-member Board of Directors (Governing Board) and is responsible for controlling emissions primarily from stationary sources of air pollution. The County’s representative on SCAQMD is Supervisor Curt Hagman, who receives assistance from his staff members, Michael Miller and Peter J. Rogers.

 

On June 27, 2023 (Item No. 57), the Board approved revenue Contract No. 23-585 to continue to allow the County to be reimbursed by SCAQMD for staff time associated with participation in SCAQMD by County staff Mr. Rogers, for the period of July 1, 2023, through June 30, 2024, in the not-to-exceed amount of $12,923.  On September 10, 2024 (Item No. 25), the Board approved revenue Contract No. 24-814 with SCAQMD for Mr. Rogers’ time associated with the County’s continued participation in SCAQMD, in the not-to-exceed amount of $11,416, for the contract term of July 1, 2024, through June 30, 2025.

 

This item seeks approval of Amendment No. 2 to Employment Contract No. 22-854 to increase the salary range, retroactively effective November 30, 2024, due to additional SCAQMD duties performed as of December 1, 2024 and to align with the start of the pay period. Amendment No. 2 also adds to Employment Contract No. 22-854 the additional scope of work performed as of December 1, 2024.  A future item will be presented to the Board in 2025 requesting approval of Amendment No. 1 to SCAQMD Contract No. 24-814 pertaining to these additional duties.

 

Either party may terminate the contract at any time without cause with a 14-day prior written notice to the other party. The contract may be terminated for just cause immediately by the County.
