RECOMMENDATION(S)
Recommendation
1. Approve the termination of Funding Agreement No. 16-1001376 (County Contract No. 16-230) with the San Bernardino County Transportation Authority after receipt of the final reimbursement for incurred costs related to the Arrowbear Drive Bridge Project.
2. Approve Amendment No. 1 to Funding Agreement No. 20-1002325 (County Contract No. 20-41) with San Bernardino County Transportation Authority to increase the Measure “I” 2010-2040 Mountains Subarea Major Local Highways Program funding by $3,727,204 (from $500,000 to $4,227,204) for the intersection improvement project on State Route 38 at Stanfield Cutoff in the Big Bear Lake area, based on the current design, added right-of-way and construction phases, update Funding Agreement Attachments “A” and “B,” and extend the Funding Agreement termination from June 30, 2022 to December 30, 2025.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). Recommendation No. 2 requests approval to increase the Measure “I” 2010-2040 Mountains Subarea Major Local Highways Program (MLHP) funding by $3,727,204, from $500,000 to $4,227,204. San Bernardino County Transportation Authority (SBCTA) is the administrator of the MLHP revenues and agrees to reimburse San Bernardino County (County) up to $4,227,204 for eligible costs related to the road improvements at the intersection of State Route (SR) 38 and Stanfield Cutoff, in the Big Bear Lake area (Project). In addition to the MLHP revenue, the Project will also be funded by the State of California (State), State Highway Operations and Protection Program (SHOPP) Minor B funds of $300,000. Sufficient appropriation is included the Department of Public Works (Department) 2021-22 Road Operations budget (6650002000 H15055) and will be included in future recommended budgets.
BACKGROUND INFORMATION
Stanfield Cutoff is a two-lane north-south road that intersects east-west SR 38 at a four-leg approach. The current intersection has a four-way stop control. While the east and west approaches run in a straight line, the north approach is offset from the south approach. The new intersection configuration has been determined and the improvements include the construction of a roundabout. SBCTA has agreed to increase the MLHP funding by $3,727,204 (from $500,000 to $4,227,204) and will use the MLHP revenues allocated to the Arrowbear Drive Bridge Project for the SR 38 at Stanfield Cutoff Project upon termination of Funding Agreement No.16-1001376 (County Contract No. 16-230), and other available MLHP funding in the Mountains Subarea account. The Project will also receive $300,000 SHOPP Minor B funds from the State, resulting in a total of $4,527,204 of funding for the Project. The purpose of the Project is to improve the intersection and construct a roundabout to optimize traffic circulation and alleviate traffic congestion surrounding the SR 38 at Stanfield Cutoff area, ensuring a well-planned, balanced, and sustainable county.
On May 24, 2016 (Item No. 119), the Board of Supervisors (Board) entered into Funding Agreement No. 16-1001376 (County Contract No. 16-230), which authorized the County to receive MLHP funds in an amount of $3,000,000 to fund the design and construction phases for the Arrowbear Drive Bridge Project.
On January 28, 2020 (Item No. 29), the Board approved Amendment No. 1 to Funding Agreement No. 16-1001376 (County Contract No. 16-230) with SBCTA, which reduced the Arrowbear Drive Bridge project MLHP allocation by $500,000 (from $3,000,000 to $2,500,000). The $500,000 was reallocated to the SR 38 at Stanfield Cutoff Project.
On January 28, 2020 (Item No. 30), the Board entered into Funding Agreement No. 20-1002325 (County Contract No. 20-41), which authorized the County to receive MLHP funds in an amount of $500,000 for the planning study, project approval and environmental documents (PA/ED) and plans, specifications, and estimate (PS&E) phases of the Project.
Recommendation No. 1 requests Board approval to terminate the Arrowbear Drive Bridge Project Funding Agreement No. 16-1001376 (County Contract No. 16-230) in the amount of $2,500,000 because the project study found it unfeasible without significantly more funds secured to address the type of repairs required for the old dam beneath the Arrowbear Drive Bridge. The remaining $2,500,000 MLHP allocation for the Arrowbear Drive Bridge Project will be reallocated to the SR 38 at Stanfield Cutoff Project. Upon approval of Recommendation No. 1 and after the County receives the final reimbursement of outstanding costs related to the Arrowbear Drive Bridge Project, Funding Agreement No. 16-1001376 (County Contract No. 16-230) will be terminated.
Recommendation No. 2 requests Board approval to enter into Amendment No. 1 to Funding Agreement No. 20-1002325 (County Contract No. 20-41), which includes an increase to the MLHP allocation for the Project by $3,727,204 (from $500,000 to $4,227,204) based on the current design, and added right-of-way and construction phases. The proposed Amendment No. 1 also updates the Funding Agreement Attachment “A” Project Milestone with revised dates and Attachment “B” Summary of Estimated Costs, and extends the contract termination from June 30, 2022 to December 30, 2025. All other terms and conditions of Funding Agreement No. 20-1002325 (County Contract No. 20-41) remain unchanged. The Project is in the design phase, and construction is anticipated to commence in Spring 2023.
SBCTA anticipates to present the termination of Funding Agreement No. 16-1001376 (County Contract No. 16-230) and Amendment No. 1 to Funding Agreement No. 20-1002325 (County Contract No. 20-41) to its Board of Directors on March 2, 2022.
