RECOMMENDATION(S)
Recommendation
Acting as the governing body of the Board Governed County Service Area 60-Apple Valley Airport (CSA 60):
1. Approve a use permit with Frank Tanner, Trustee of the Tanner Family Trust dated July 11, 1983 in the amount of $200, for the use of approximately 7.52 acres of vacant land located west of the Apple Valley Airport to serve as overflow parking for the 2019 Apple Valley Airshow for the period of October 11, 2019 through October 13, 2019.
2. Approve use permit with Frank Tanner, Trustee of the Tanner Family Trust dated May 10, 1962, in the amount of $200, for use of approximately 6.2 acres of vacant land located west of the Apple Valley Airport to serve as overflow parking for the 2019 Apple Valley Airshow for the period from October 11, 2019 through October 13, 2019.

FINANCIAL IMPACT
Approval of this item will not require Discretionary General Funding (Net County Cost). On July 9, 2019 (Item No.49) the Board authorized the necessary funding from the CSA 60 for the 2019 Apple Valley Airshow to be held on October 12, 2019 (Event) in the total amount not to exceed $179,000 for the Event.
BACKGROUND INFORMATION
CSA 60 has hosted the annual airshow at the Apple Valley Airport (Airport) since 2008, under the promotion and administration of the County Department of Airports. This annual Event attracts a wide audience of attendees and provides an opportunity to promote the County of San Bernardino. The proposed recommendations approve two permits to use private property for overflow parking for the Event.
The Event aligns with the County and Chief Executive Officer Goals and Objectives by promoting economic value through community entertainment and aviation-themed concessions.
Approximately 7,715 people attended the 2018 Apple Valley Airshow, which was lower than anticipated due to inclement weather, and approximately 15,400 people attended 2017 Apple Valley Airshow. It is expected that the Event will have a similar attendance as the 2017 event, necessitating the use of overflow parking to ensure the safety of the County residents and visitors. The recommended use permits with the landowners (Tanner Family Trust dated July 11, 1983 and Tanner Family Trust dated May 10, 1962) will allow CSA 60 to use the land as overflow parking for the Event for the period of October 11 through October 13, 2019.
The use permits each contain a non-standard indemnity that requires CSA 60 to indemnify and hold harmless the landowner and its officers, employees, agents, and volunteers from any and all liabilities for injury to person and damage to property arising out of any negligent act or omission of CSA 60, its officers, employees, agents, and volunteers in connection with CSA 60’s use of each premises. Historically, the landowner has advised that it carries a liability policy for its properties, but has declined to include an express commitment in the use permits to carry such insurance or to name CSA 60 as an additional insured, which means that CSA 60 may have liability exposure in the event of a claim.
