Recommendation

Approve Amendment No. 1 to the following contracts, for on-call planning, environmental, and mining compliance services, increasing the total not to exceed amount by $5,700,000, from $6,000,000 to $11,700,000 with no change to the contract period of November 19, 2024, through November 18, 2027, with two one-year options to extend:

FINANCIAL IMPACT

Approval of this item may result in the use of additional Discretionary General Funding (Net County Cost). The total contract costs between November 2024 and August 2025 are approximately $5.3 million of the $6 million maximum. An increase of $5.7 million is needed to support continued timely services for planning, environmental, and mining compliance with federal, state, and local requirements. The Land Use Services Department’s (LUS) costs for projects initiated by applicants are funded primarily with Board of Supervisors (Board) approved fees. To the extent that existing funds are not adequate to support 2025-26 costs, LUS may return to the Board to request additional one-time Discretionary General Fund.

 

BACKGROUND INFORMATION

LUS’ Planning Division is the designated planning agency for San Bernardino County (County) and is responsible for guiding the urban and rural development in the unincorporated areas of the County through the administration of policies and codes adopted by the Board and in compliance with various state laws. To respond quickly to fluctuations in workload and to meet applicant needs for specialized environmental analysis, LUS uses a pre-qualified on-call consultant list to provide the following planning services:

                     General planning services to process land use and development applications as an extension of County staff.

                     Environmental analysis services to prepare environmental documents pursuant to the California Environmental Quality Act and National Environmental Policy Act.

                     Surface Mining and Reclamation Act of 1975 (SMARA) compliance services to assist LUS with the implementation of lead agency responsibilities including, but not limited to, inspections, reviews of reclamation plans, plans of operations, financial assurance cost estimates, and communications on behalf of the County with mine operators and the California Department of Conservation, Division of Mine Reclamation.

 

On November 19, 2024 (Item No. 26), the Board approved competitive contracts under Request for Proposals No. LUSD20-LUS-5537, authorizing an aggregate amount not to exceed $6,000,000 for general planning, environmental analysis, and mining compliance services, for the period November 19, 2024, through November 18, 2027, with two optional one-year extensions.

 

Approval of the on-call contract services augmentation is recommended to address a higher-than-projected in-house staff vacancy rate and an unanticipated increase in services requiring specialized credentials or expertise not available in-house, resulting in LUS expending the aggregate contract amount faster than anticipated. This trend is expected to continue through the end of the contracts period. Approval of this item will allow LUS to continue utilizing vendors based on expertise, availability, and project needs to ensure the County continues to meet the needs of county residents.
