Recommendation
Acting as the governing body of the San Bernardino County Fire Protection District, approve Amendment No. 1, retroactively effective July 1, 2024, to Revenue Agreement No. 22-390 with the City of Upland for Fire and Life Safety Protection Services, amending the personnel and equipment rates, with all other contract terms remaining in effect, for a total contract period of May 24, 2022, through June 30, 2025.

FINANCIAL IMPACT
Approval of the recommended Amendment No. 1 (Amendment) to Revenue Agreement No. 22-390 (Agreement) will not result in the use of Discretionary General Funding (Net County Cost). The actual cost for San Bernardino County Fire Protection District (SBCFPD) to provide onsite fire and life safety protection services at the City of Upland’s (City) events will vary depending on the number and size of the events scheduled. Services will be billed to the City at hourly rates as identified in the Amendment, and the revenue from this Amendment will provide full cost recovery for SBCFPD. Sufficient appropriation and revenue are included in SBCFPD’s 2024-25 budget.
BACKGROUND INFORMATION
On May 24, 2022 (Item No. 106), the Board of Directors (Board) approved the Agreement allowing SBCFPD staff to provide onsite fire and life safety protection services for City sponsored events. The City hosts several events throughout the year, including its annual Lemon Festival. The City recognizes that various fire and life hazards can occur in the operation of their events.
As a result, the City and SBCFPD entered into the Agreement allowing SBCFPD to provide additional services for scheduled special City events. The Agreement also provides that for 2023-24 and 2024-25, the City shall reimburse SBCFPD at the current personnel and equipment rates noted in the SBCFPD fee ordinance. However, the cost of providing this service to the City is different than the cost identified in the 2024-25 fee ordinance. Therefore, approval of the Amendment updates the reimbursement rates to reflect negotiated rates for personnel and equipment, rather than fee ordinance rates, effective July 1, 2024. These rates have been specifically tailored to the City to cover costs not included as part of SBCFPD’s role as the fire authority within the City.
In addition, providing this service to the City at the personnel and equipment rates identified in the Amendment provides for the safety, health, and social service needs of SBCFPD and County residents and serves a SBCFPD purpose by enhancing the emergency response capabilities of SBCFPD at City special events. The Amendment will allow SBCFPD to continue to provide onsite services, including having Firefighter Paramedics and Firefighter Emergency Medical Technicians present, during the City’s special events through June 30, 2025.
Approval of the Amendment will amend the personnel and equipment rates identified in the Agreement, with all other terms of the Agreement remaining the same. It is retroactive to July 1, 2024, due to a delay in contract negotiations and subsequent time required for fiscal and legal reviews. Either party may terminate the Agreement with 30 days’ written notice.
