Recommendation
1. Conduct a public hearing to consider necessary revisions to San Bernardino County Code Section 16.0215B(b)(2)(I), related to the Department of Public Works - Development, and the Regional Transportation Development Mitigation Plan fee for Truck Storage/Drop Lot fee amount in the Apple Valley Sphere of Influence Subarea.
2. Make alterations, if necessary, to proposed ordinance.
3. Approve introduction of proposed ordinance.
* An ordinance of San Bernardino County, State of California, to amend Subsection 16.0215B(b)(2)(I) of Chapter 2 of Division 6 of Title 1 of the San Bernardino County Code, relating to Regional Transportation Development Mitigation Plan fees charged by the County for Truck Storage/Drop Lot within the Apple Valley Sphere of Influence.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). This revision will correct the Truck Storage/Drop Lot fee per acre for the Apple Valley Sphere of Influence Subarea from $12,334.66 to $13,334.66.
BACKGROUND INFORMATION
On November 5, 2024 (Item No. 54), the Board of Supervisors (Board) held a public hearing to consider necessary revisions to County Fee Ordinance Section 16.0215B, Department of Public Works - Development, and Regional Transportation Development Mitigation Plan Fees. Following the hearing, the Board adopted Resolution No. 2024-161, approving the updated Regional Transportation Development Mitigation Plan (Plan) Report. As part of the updated Plan, the Board established a new "Truck Storage/Drop Lot" land use category and corresponding fee calculation methodology for offsite and supplemental onsite warehouse truck staging lots. The approved Plan established a fee for Truck Storage/Drop Lot uses located within the Apple Valley Sphere of Influence Subarea at $13,334.66 per acre.
Subsequently, on November 19, 2024 (Item No. 70), the Board adopted Ordinance No. 4480, amending Subsection 16.0215B(b) of Chapter 2, Division 6, Title 1 of the San Bernardino County Code to the update fee amounts consistent with the Board-approved Plan Report. However, due to an inadvertent error, Ordinance No. 4480 incorrectly listed the Truck Storage/Drop Lot fee for the Apple Valley Sphere of Influence as $12,334.66 per acre, which is $1,000 less than the fee amount adopted by the Board in the Plan Report.
The proposed ordinance corrects this error by amending Subparagraph 16.0215B(b)(2)(I) to reflect the accurate and previously approved fee amount of $13,334.66 per acre. This revision ensures consistency between the County Code and the Regional Transportation Development Mitigation Plan as adopted by the Board.
A public hearing is required to consider fee revisions to the County Code. Following the hearing, the Board may approve the introduction of the ordinance and schedule it for final adoption.
