RECOMMENDATION(S)

Recommendation

1.                     Approve Cooperative Agreement between San Bernardino County and the City of Fontana, effective upon execution by both parties through December 31, 2028, wherein each agency will contribute $87,016 and $3,763,463, respectively, towards the estimated cost of $3,850,479 for the Chestnut Avenue Pavement Reconstruction Project in the Fontana area.

2.                     Authorize the Director of the Department of Public Works or the Assistant Director of the Department of Public Works, to increase the County’s contribution amount up to 25 percent, from $87,016 to $108,770, should improvement costs necessitate such an increase.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The total estimated cost of the pavement improvements for the Chestnut Avenue Pavement Reconstruction Update Project in the Fontana area (Project) is $3,850,479. The County’s share of cost is estimated to be $87,016 and will be funded with the Senate Bill 1 Road Maintenance and Rehabilitation Account. The remaining cost of the Project, estimated to be $3,763,463, will be funded by the City of Fontana (City).  Sufficient appropriation and revenue for the Project are included in the Department of Public Works (Department) 2022-23 Road Operations budget and will be included in future recommended budgets (6650002000 H15213).

 

BACKGROUND INFORMATION

The Project is a shared jurisdiction road and is part of a larger City project that includes Chestnut Avenue, between Ilex Street east to Cottonwood Avenue, in the Fontana area. The Project improves approximately 0.20 miles of pavement and is of mutual benefit to the City and County. The work primarily consists of milling the existing pavement and overlaying the pavement with new rubberized asphalt hot mix.  The Project is in the final design phase and construction is anticipated to commence in Summer 2023.

 

In accordance with the provisions of the proposed Cooperative Agreement, the City will serve as the lead agency in the preliminary engineering, design, survey, California Environmental Quality Act (CEQA) review and compliance, construction and inspection phases of the Project. If right-of-way is necessary for the Project, the City and County will each perform the service within their respective jurisdictions, at their own cost. Unless terminated prior to the award of the construction contract, the proposed Cooperative Agreement will terminate upon completion of the Project and payment by the City, or on December 31, 2028, whichever occurs first.  The City approved the Cooperative Agreement on May 9, 2023.

 

To prevent delays in Project completion, this item also recommends that the Board authorize the Director of the Department, or the Assistant Director, to increase the County’s contribution amount under the proposed Cooperative Agreement by up to 25 percent, from $87,016 to $108,770, should costs necessitate such an increase.

 

The Project meets the County and the Chief Executive Officer’s goals and objectives to ensure the development of a well-planned, balanced and sustainable County by preserving and improving the structural integrity of the existing road surfaces and adding curb ramps. Furthermore, execution of the Cooperative Agreement will allow the County to meet its goals and objectives by working cooperatively with the City.
