Increased Spending Authority for Body Transport Services Contracts

RECOMMENDATION(S)
Recommendation
1. Authorize Purchasing Agent to increase the total aggregate spending authority amount by $1,055,000, from $1,200,000 to $2,255,000, with no change to the term of May 1, 2020 through April 30, 2023, for the following body transport services contracts:
a. Med-Cab Non-Emergency Medical Transportation, dba All-In-One Logistics Care, LLC, Contract No. 20-159.
b. Wiefels & Son II, Inc., Contract No. 20-160.
2. Authorize the Sheriff/Coroner/Public Administrator or Undersheriff to execute change orders to the contracts as needed, subject to review by County Counsel, in an amount not to exceed $200,000 per change order, so long as the total aggregate amount of such change orders does not exceed 20% ($451,000) of the new spending authority amount for the contracts ($2,255,000), and the change orders do not amend the contract term.
3. Direct the Sheriff/Coroner/Public Administrator or Undersheriff to transmit all change orders to the Clerk of the Board of Supervisors within 30 days of execution.
4. Authorize the Auditor-Controller/Treasurer/Tax Collector to post appropriation and revenue adjustments to the Sheriff/Coroner/Public Administrator’s 2021-22 budget in the amount of $305,000 as detailed in the Financial Impact Section (Four Votes Required).

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). The increased cost of body transport services for 2021-22 will be funded through a $305,000 increase in Proposition 172 (Prop 172) funding allocated to the Sheriff/Coroner/Public Administrator (Department). The 2021-22 budget adjustment pertaining to this allocation is reflected in the following table:

The Department’s 2022-23 Recommended Budget will include additional Prop 172 funding for the continued cost of body transport services.
BACKGROUND INFORMATION
Per Government Code Section 27491, the Department’s Coroner Division (Coroner) is responsible for investigating certain categories of deaths that occur within San Bernardino County (County). This includes determining the cause of death and clarifying all circumstances surrounding or pertaining to the manner of death of a decedent; the Coroner may order the removal of a body from a death scene for further investigation.
On March 24, 2020 (Item No. 55), as a result of a competitive bid process, the Board of Supervisors (Board) approved Contract No. 20-159 with Med-Cab Non-Emergency Medical Transportation, dba All-In-One Logistics Care, LLC (All-In-One), and Contract No. 20-160 with Wiefels & Son II, Inc. (Wiefels) for body transport services, with a total spending authority amount of $450,000 for the period of May 1, 2020 through April 30, 2023, with the option to extend the contracts for two additional one-year terms, or one two-year extension to the original term.
After the onset of the COVID-19 pandemic, County mortuaries and funeral homes reached storage capacity limits and were limited in their ability to transport additional decedents, due to both natural and COVID-19 related deaths. As a community partner, the Department created temporary COVID-19 operating procedures and assumed additional responsibilities in assisting hospitals, mortuaries, funeral homes, convalescent homes, and skilled nursing facilities in transporting and storing natural death decedents until burial or cremation services could be arranged. This resulted in a significant increase in the number of transports and actual costs of body transport services provided by All-In-One and Wiefels. Accordingly, on April 20, 2021 (Item No. 50), the Board approved an increase to the total spending authority amount for the All-In-One and Wiefels contracts from $450,000 to $1,200,000, with no change to the term of the contracts.
Approval of this item will further increase the aggregate spending authority amount with All-In-One and Wiefels from $1,200,000 to $2,255,000, thus allowing the Department to continue to utilize these contractors for body transport services through the end of the contract term (April 30, 2023).
PROCUREMENT
Increasing the spending authority amount for these contractors does not require additional procurement actions.
