Construction Contract with KNC Construction, Inc. for the Mojave Barn and Corrals Revitalization Project

RECOMMENDATION(S)
Recommendation
1. Approve Addendum No. 1, dated July 9, 2024, for the Mojave Barn and Corrals Revitalization Project, located at 18000 Yates Road in Victorville, which made the following changes and updates to the bid documents:
a. Changed the bid opening from July 11, 2024, to July 17, 2024, at 11:00 a.m.
b. Updated construction contract sample.
c. Responded to bidder-submitted questions.
2. Find the bid proposal from Wakeco, Inc. to be nonresponsive for failing to submit an executed non-collusion declaration, receipt of Addendum No. 1, and a signed bid as required in the bid proposal and the Public Contract Code section 7106.
3. Award a construction contract to KNC Construction, Inc., in the amount of $1,091,500, for the Mojave Barn and Corrals Revitalization Project located at 18000 Yates Road in Victorville.
4. Approve a $270,025 decrease to Capital Improvement Program Project No. 23-139, decreasing the project budget, from $1,899,872 to $1,629,847, for the Mojave Barn and Corrals Revitalization Project located at 18000 Yates Road in Victorville.
5. Authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments to the Capital Improvement Program 2024-25 budget, as detailed in the Financial Impact section.
6. Authorize the Director of the Project and Facilities Management Department to order any necessary changes or additions to the work being performed under the construction contract for a total amount not to exceed $67,075 pursuant to California Public Contract Code Section 20142.
7. Authorize the Director of the Project and Facilities Management Department to accept the work when 100% complete and execute and file the Notice of Completion.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The recommended decrease in the Mojave Barn and Corrals Revitalization Project (Project) budget of $270,025 will decrease the Project budget from $1,899,872 to $1,629,847 and will continue to be funded from the American Rescue Plan Act (ARPA).

The Project budget of $1,629,847 is funded by the American Rescue Plan Act (ARPA), which includes a project contingency of $163,725 that may be obligated by December 31, 2024, as required by the ARPA. Sufficient appropriation and revenue are included in the 2024-25 Capital Improvement Program (CIP) budget to award this contract.
BACKGROUND INFORMATION
Approval of this item will allow PFMD to award a construction contract to KNC Construction, Inc. for the Project located in Mojave Narrows Regional Park (Mojave Narrows). PFMD is also seeking approval to decrease the Project by $270,025 since the bids came in lower than expected, which resulted in a decrease to the construction contingency amount. The County owned barn and corrals at Mojave Narrows that is used by a concessionaire for the benefit of visitors is currently closed due to the extensive damage in the existing equestrian barn.
On May 21, 2024 (Item No. 58), the Board of Supervisors (Board) determined that the Project qualifies for a categorical exemption from further review under the California Environmental Quality Act Guidelines (Title 14, California Code of Regulations). Specifically, the Project falls under Section 15303, Class 3, Subsection (e) pertaining to new construction of accessory (appurtenant) structures including garages, carports, patios, swimming pools, and fences.
This Project is consistent with County Administrative Office approved CIP request No. 23-139.
PROCUREMENT
On May 21, 2024 (Item No. 58), the Board authorized PFMD to advertise for competitive bids. PFMD advertised for bids in the San Bernardino County Sun, six plan rooms and on the County Electronic Procurement Network (ePro) on May 24, 2024. On June 6, 2024, potential bidders attended a mandatory job walk. On July 9, 2024, Addendum No. 1 was issued which changed the bid opening from July 11, 2024, to July 17, 2024, updated the construction contract template, and posted the responses to bidder submitted questions. On July 17, 2024, the following seven bids were received.

On July 17, 2024, at 11:00 a.m., Wakeco, Inc., failed to provide an executed non-collusion declaration, receipt of Addendum No. 1, and a signed bid as required in the bid proposal and by Public Contract Code section 7106. For this reason, the bid proposal from Wakeco, Inc. was determined to be nonresponsive and Wakeco., Inc. was notified by certified mail that PFMD would recommend to the Board that its proposal be found nonresponsive. PFMD did not receive protests.
PFMD recommends the Board award the Construction contract to KNC Construction, Inc., the lowest responsive and responsible bidder.
