RECOMMENDATION(S)

Recommendation

1.                     Acting as the governing body of San Bernardino County:

a.                     Approve the use of $1,315,526 from the Bloomington Community Benefit/Improvement Reserve to the Bloomington Recreation and Park District for the Kessler Park Dream Field Project.

b.                     Approve Contract with the Bloomington Recreation and Park District to provide funding in the amount of $1,825,300 from Discretionary General Funding for the Kessler Park Dream Field Project, for a contract term of July 23, 2024, through July 22, 2026.

c.                     Authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments, as detailed in the Financial Impact section, for the Kessler Park Dream Field Project (Four votes required).

2.                     Acting as the governing body of Bloomington Recreation and Park District:

a.                     Approve Contract with San Bernardino County for Bloomington Recreation and Park District to receive funding in the amount of $1,825,300 from Discretionary General Funding for the Kessler Park Dream Field Project, for a contract term of July 23, 2024, through July 22, 2026. 

b.                     Authorize the Auditor-Controller/Treasurer/Tax Collector to post the necessary budget adjustments, as detailed in the Financial Impact section (Four votes required).

c.                     Approve Addendum No. 1, issued on May 30, 2024, Addendum No. 2, issued on June 3, 2024, and Addendum No. 3 issued on June 4, 2024, to the bid documents for the Kessler Park Dream Field Project.

d.                     Award construction contract to Los Angeles Engineering, Inc., in the amount of $2,757,000 for the Kessler Park Dream Field Project.

e.                     Authorize the Director of the Department of Public Works to approve expenditures up to $275,700 for verified quantity overruns for this unit priced construction contract.

f.                     Authorize the Director of the Department of Public Works to approve necessary changes or additions in the work being performed under the construction contract for a total amount not-to-exceed $150,350 of the $275,700 reserved for verified quantity overruns, pursuant to Public Contract Code Section 20142.

g.                     Authorize the Director of the Department of Public Works to issue additional compensation for early completion, not-to-exceed $35,000.

h.                     Authorize the Director of the Department of Public Works to accept the work when 100% complete and execute and file the Notice of Completion.

FINANCIAL IMPACT

Approval of this item will result in the use of Discretionary General Funding (Net County Cost).

 

On March 28, 2023 (Item No. 64), the Board of Supervisors (Board) approved an allocation of $2,300,000 from the Fifth District’s Priorities Program budget for the Kessler Park Dream Field Project (Project).

 

On July 25, 2023 (Item No. 70), the Board reallocated $1,950,000 of these funds to the Kessler Park Corridor Project and adjusted the Project budget to $350,000 to fund the design and project management of the Project only.

 

Approval of this item will allocate $1,315,526 from the Bloomington Community Benefit/Improvement Reserve. Approval of this item would also allocate $1,825,300 from Discretionary General Funding, resulting in a decrease of General Fund contingencies. Combined, these actions would result in total additional funding of $3,140,826 for the Project. Sufficient appropriation for the Project will be included in the District’s future recommended budgets as needed.

BACKGROUND INFORMATION

The Bloomington Recreation and Park District (District) maintains two community parks (Ayala Park and Kessler Park), an equestrian arena, sports fields, and a community center that offer various recreational activities for the community of Bloomington.  The Department of Public Works - Special Districts (Department), through its Operations Division, directly manages, operates, and maintains the District, including Kessler Park.

This item seeks approval to award a construction contract for the Project. The Project consists of demolishing, replacing, and upgrading the field with synthetic turf, improved dugouts, new bleachers with shade, a scoring/announcing stand, and a new electronic scoreboard for Ballfield No. 2.  The overall design intent is to bring a “big league” theme and feel to a Little League facility, making it a “Dream Field.”  The ballfield dimensions and proportions will remain consistent with the existing Little League layout.

 

On May 7, 2024 (Item No. 52), the Board of Directors determined the Project was exempt under the California Environmental Quality Act and directed the Department to file and post said notice.

 

The Project aligns with the District and the Chief Executive Officer’s goals and objectives of ensuring development of a well-planned, balanced, and sustainable County by preserving and improving community park facilities that provide for the recreational opportunities and experiences for the community.

 

PROCUREMENT

On May 7, 2024 (Item No. 52), the Board of Directors approved the Project’s plans and specifications and authorized the Director of the Department to advertise the Project for bids. On May 7, 2024, the Department advertised for bids through the County Electronic Procurement Network (ePro) website in accordance with Public Contract Code Section 22037.  On May 16, 2024 and May 23, 2024, the Department advertised for bids by publishing the Project in the San Bernardino County Sun newspaper.

 

During the bidding process, the following addendums were issued:

 

                     Addendum No. 1: Change in last day to submit questions and correct file uploaded for Section E; Instructions to Bidders in Bidding Requirements.

 

                     Addendum No. 2: Bid Proposal Change and Plan Set and Technical Specification Revisions; Bid Proposal in Bidding Requirements and Contract Drawings.

 

                     Addendum No. 3: Provided all interested parties with all the questions and responses gathered through the bid process and added the GoToMeeting link.

 

On May 23, 2024, a total of six contractors attended a mandatory pre-bid site meeting. On June 6, 2024, the following bids were received:

The Department reviewed the bids received for the Project, determined that the low bid was responsive, and recommends an award of the construction contract to Los Angeles Engineering, Inc., as the lowest responsible bidder. No appeal/protest letters have been received.

 

The lowest bidder was determined pursuant to Public Contract Code section 20103.8(b), the lowest total of the bid prices on the base contract, and those additive or deductive items that were specifically identified in the bid solicitation, which included the lowest total of the total base bid plus Additive Bid No. 1 (Safety Mesh Fence), Additive Bid No. 2 (Concrete Paving), and Additive Bid No. 3 (Storage Shed). The Department has elected to move forward with awarding the Base Bid ($2,601,275) plus Additive Bid Nos. 1, 2, and 3 ($155,725), for a total contract amount of $2,757,000.

 

Under an established formula based on the contract amount of $2,757,000, Public Contract Code section 20142 allows the Board of Directors to authorize the Director of Public Works to order changes in the contract, including for unforeseen conditions or design shortfalls, should they become necessary in the future, for a total amount not to exceed $150,350 of the $275,700 reserved for verified quantity overruns.

 

Upon Board of Directors approval, construction is anticipated to commence in August 2024 and be completed by March 2025.
