RECOMMENDATION(S)

Recommendation

1.                     Acting as the governing body of County Service Area 70 M Wonder Valley:

a.                     Approve an increase to the Capital Improvement Program - County Service Area 70 M Wonder Valley - Community Center Upgrades, in the amount of $191,000, from $499,650 to $690,650.

b.                     Authorize the Auditor-Controller/Treasurer/Tax Collector to post budget adjustments as detailed in the Financial Impact section, for the County Service Area 70 M Wonder Valley - Community Center Upgrades (Four votes required).

c.                     Approve Addendum No. 1, issued on May 7, 2024, to the bid documents for County Service Area 70 M Wonder Valley - Community Center Upgrades.

d.                     Award construction contract to KNC Construction, Inc., in the amount of $333,928, for the County Service Area 70 M Wonder Valley - Community Center Upgrades.

e.                     Authorize the Director of the Department of Public Works to approve necessary changes or additions in the work being performed under the construction contract with KNC Construction, Inc., for a total amount not-to-exceed $29,196, pursuant to Public Contract Code Section 20142.

f.                     Authorize the Director of the Department of Public Works to accept the work when 100% complete, and to execute and file the Notice of Completion.

2.                     Acting as the governing body of San Bernardino County, approve an increase of $191,000, from $499,650 to $690,650, of American Rescue Plan Act funding for eligible costs associated with the County Service Area 70M Wonder Valley - Community Center Upgrades.

FINANCIAL IMPACT

Approval of this item will not result in the use of Discretionary General Funding (Net County Cost).  On January 24, 2023 (Item No. 65), the Board of Supervisors (Board) approved the use of $325,000 from the County’s American Rescue Plan Act (ARPA) Coronavirus Local Fiscal Recovery Fund (CLFRF) for eligible costs.

 

On June 11, 2024 (Item No. 110), the Board approved the use of an additional $174,650 from County CLFRF for eligible costs for the County Service Area 70M Wonder Valley (District) - Community Center Upgrades (Project) and adjusted the Project budget to $499,650 as part of the County’s 2024-25 Budget.

 

Approval of this item will authorize an increase of $191,000 in funding for the Project, raising the total from $499,650 to $690,650, from the County’s CLFRF for eligible costs. This additional funding will cover the remaining contract amount, inspection services, and project contingency costs. Sufficient appropriation for the Project will be included in future recommended budgets as needed.

BACKGROUND INFORMATION

The District was established by the Board on July 1, 1991, to provide park and recreation services. The Department of Public Works - Special Districts (Department), through its Operations Division directly manages, operates and maintains the District, including the existing Wonder Valley Community Center (Community Center).

 

The Project proposes general repairs, improvements to equipment, kitchen improvements, replacement of the kitchen, installation of lighting for energy efficiency and safety, and the installation of a commercial-grade reverse osmosis water filtration system at the Community Center.

 

On March 26, 2024 (Item No. 73), the Board determined the Project was exempt under the California Environmental Quality Act and directed the Department to file and post a notice of exemption.  The Board also approved the Project’s plans and specifications and authorized the Director of the Department to advertise the Project for competitive bids.

 

Approval of this item will allocate an additional $191,000 in ARPA funding for the completion of the Project. The additional funds are needed due to the requirement to permit the existing well site as a public water system and to allow for the installation of a commercial-grade reverse osmosis water filtration system, which were not a part of the original project.

 

Following Board approval of this item, construction is anticipated to commence in October 2024.

 

PROCUREMENT

On March 26, 2024 (Item No. 73), the Board approved the Project’s plan and specifications and authorized the Director of the Department to advertise the Project for bids.  On March 29, 2024, the Department advertised the Project for bids through the County Electronic Procurement Network (ePro) and in accordance with Public Contract Code Section 22037.  On April 9, 2024 and April 16, 2024, the Department advertised for bids by publishing the Project in the San Bernardino County Sun Newspaper and the Hi-Desert Star Newspaper on April 10, 2024 and April 17, 2024.

 

During the bidding process, the following addendum was issued:

 

                     Addendum No. 1: Provided all interested parties with all Questions and Responses gathered through the bid process.  Updated Section A - Bidding Requirements, Section F - Technical specifications and Section G - Contract Drawings.

 

On April 23, 2024, a total of nine contractors attended a mandatory pre-bid site meeting. On May 16, 2024, the Department received the following three bids:

The Department reviewed the bids received for the Project, and determined that the low bid was responsive, and recommends an award of construction contract to KNC Construction, Inc., as the lowest responsible bidder.  No protest/appeal letters were received.

 

The lowest bidder was determined, pursuant to Public Contract Code section 20103.8(b), as the lowest total of the total base bid plus Additive Bid No. 1 (Hallway and Restroom Area), Additive Bid No. 2 (Reverse Osmosis System Unit and Enclosure). The District recommends moving forward with awarding the Base Bid ($251,518) plus Additive Bid No. 2 only ($82,410), for a total contract amount of $333,928.

 

Under an established formula based on the contract amount of $333,928, Public Contract Code Section 20142 allows the Board to authorize the Director of the Department to order changes in the contract, including for unforeseen conditions or designed shortfalls, should they become necessary in the future, for a total amount not to exceed $29,196.
