RECOMMENDATION(S)
Recommendation
1. Find the vacation of portions of Irrevocable Offers of Dedication, Easements, and Reservations for landscaping, irrigation, planting, maintenance, drainage, water quality, and public utility easements as reserved, dedicated, or irrevocably offered to the benefit of San Bernardino County as shown on said Parcel Map No. 20478, in the Fontana area, is an exempt action under the California Environmental Quality Act Guidelines pursuant to Class 12, Section 15312 Surplus Government Property Sale and 15061 (b)(3) - Common Sense Exemption.
2. Adopt Resolution that finds and determines that the portions of Irrevocable Offers of Dedication, Easements, and Reservations for landscaping, irrigation, planting, maintenance, drainage, water quality, and public utility easements as reserved, dedicated, or irrevocably offered to the benefit of San Bernardino County as shown on said Parcel Map No. 20478, in the Fontana area, are in excess and may be vacated to achieve the public purpose of eliminating and clearing the public records of unusable and unnecessary easements.
3. Direct the Clerk of the Board of Supervisors to forward a certified copy of the Resolution to the Department of Public Works to be recorded as an official record by the San Bernardino County Recorder.
4. Direct the Department of Public Works to file the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). All costs associated with the vacation are applicant-funded through the approved vacation/abandonment fees.
BACKGROUND INFORMATION
The summary vacation will remove interests for landscaping, irrigation, planting, maintenance, drainage, water quality, and public utility easements (collectively, Interests) to the benefit of San Bernardino County as described in Exhibits 1 - 4 and shown on Parcel Map No. 20478, recorded in Parcel Map Book (PMB) 263, pages 53-73, an official record of San Bernardino County. The boundaries of said parcel map are located within the unincorporated territory of San Bernardino County in the Fontana area. The Interests have been unused, are in excess, and are not necessary for current or future public benefit or use.
The County received the Interests via Parcel Map 20478 in 2024. Since its recordation the Interests have been unused by the public in general. Speedway SBC Development, LLC, a Delaware Limited Liability Company, has relocated landscape areas and parcel lines via a Lot Line Adjustment recorded in Document No. 2025-0208408, which has superseded the use of the Interests.
The Department of Public Works (Department) has completed its review of the request to vacate the Interests and finds that this vacation will not affect the existing rights, easements, right-of-way or other underlying interests of record. An exception statement has been provided in the legal descriptions for all Interests being vacated (see Resolution Exhibit A within Exhibits 1-4) and excepting any existing easements and/or underlying interests of record.
The proposed vacation serves a public purpose by eliminating and clearing the public records of unusable and unnecessary interests that have not been accepted by the general public, and by removing unnecessary title encumbrances.
The Department’s Environmental staff reviewed the request to vacate the Interests and has determined that request qualifies for a Categorical Class 12 Exemption in accordance with the California Environmental Quality Act (CEQA) Guidelines, Title 14 of the California Code of Regulations, Section 15061(b)(3) is appropriate. Class 12 consists of sales of surplus government property except for parcel of land located in an area of statewide, regional, or areawide concern identified in Section 15206(b)(3). In addition, the project is exempt from CEQA under CEQA Guidelines section 15312 as the vacated property does not have significant value for biological or cultural resources. Additionally, the Common-Sense Exemption applies when it can be seen with certainty that there is no possibility that the activity may have a significant effect on the environment. When the Board of Supervisors (Board) considers environmental findings, the filing and posting of a Notice of Exemption is recommended.
Upon Board approval of this summary vacation action, the County will no longer hold the Interests and a certified copy of the Board approved Resolution to vacate the interests will be recorded in the office of the San Bernardino County Recorder. The vacation aligns with the County and the Chief Executive Officer’s goal of ensuring development of a well-planned, balanced, and sustainable County.
