RECOMMENDATION(S)
Recommendation
1. Approve Amendment No. 2 to Intergovernmental Agreement No. 18-207, effective April 1, 2024, with the San Manuel Band of Mission Indians to increase the number of patrol vehicles provided by the Sheriff/Coroner/Public Administrator, without changes to the original term of April 17, 2018, through April 10, 2042.
2. Authorize the purchase of two patrol vehicles as unbudgeted fixed assets, in the total amount not to exceed $161,476.
3. Authorize the Auditor-Controller/Treasurer/Tax Collector to post adjustments to the Sheriff/Coroner/Public Administrator’s 2023-24 budget, as detailed in the Financial Impact section (Four votes required).

FINANCIAL IMPACT
Approval of this item will not result in the use of additional Discretionary General Funding (Net County Cost). Pursuant to Intergovernmental Agreement (IGA) No. 18-207, the Sheriff/Coroner/Public Administrator (Sheriff) is reimbursed for all direct costs and for various administrative and overhead costs to provide law enforcement services to the San Manuel Band of Mission Indians (Tribe). In addition, overtime, fuel, and vehicle maintenance are billed quarterly based on actual cost. The recommended Amendment No. 2 adds two patrol vehicles (units) to the service levels provided by the Sheriff, effective April 1, 2024, in a not to exceed one-time cost of $161,476, plus $615 for equipment and connection fees for the units.
The Sheriff requests the Auditor-Controller/Treasurer/Tax Collector post the following adjustments to the 2023-24 budget, as detailed below:

BACKGROUND INFORMATION
On April 17, 2018 (Item No. 19), the Board of Supervisors (Board) approved IGA No. 18-207 to meet the Tribe’s requirements of its Compact with the State of California to engage in gaming activities within the Tribe’s reservation area. The IGA provides for County services, staffing, and equipment, for the provision of law enforcement, fire protection, and emergency services to mitigate off-reservation impacts resulting from the expansion of the Tribe’s gaming facilities. Any requests from the Tribe for additional levels of service require the Board’s approval prior to implementation.
On June 28, 2022, (Item No. 46), the Board approved Amendment No. 1 to IGA 18-207 to add two law enforcement vehicles, increasing patrol units from five to seven for the IGA.
In January 2024, the Tribe requested to add two additional vehicles to assist with patrol of the event center during concerts and special events, increasing the total patrol units provided by the Sheriff from seven to nine, effective April 1, 2024. The cost of the two additional units, plus $615 for equipment and connection fees, is included in the attached amended Exhibit 3 that also reflects the total cost of contracted Sheriff law enforcement services for 2023-24. Approval of Amendment No. 2 will substitute a new Exhibit 3 to the IGA. No changes are requested of the District Attorney’s Office service levels.
