RECOMMENDATION(S)
Recommendation
1. Find that the Barstow Skyline East Overlay Project is exempt under the California Environmental Quality Act Guidelines, Section 15301(c) Class 1 (existing facilities) and 15302(c) Class 2 (replacement and reconstruction).
2. Approve the Barstow Skyline East Overlay Project as defined in the Notice of Exemption.
3. Approve the specifications for the Barstow Skyline East Overlay Project, as signed and sealed by a registered civil engineer.
4. Authorize the Director of the Department of Public Works to advertise the Barstow Skyline East Overlay Project for formal bids.
5. Direct the Department of Public Works to file and post the Notice of Exemption in accordance with the California Environmental Quality Act.

FINANCIAL IMPACT
Approval of this item will not result in the use of Discretionary General Funding (Net County Cost). The Barstow Skyline East Overlay Project (Project) is funded with Measure “I” Local Street Pass-Through Program North Desert Subarea funds. Sufficient appropriation is included in the 2024-25 Measure “I” Local Street Pass-Through Program North Desert Subarea budget (6650002140 TX1807) and will be included in future recommended budgets as necessary.
BACKGROUND INFORMATION
The Project involves pavement rehabilitation and mill and overlay of 1.2 miles of roads located on Balsa Avenue, Banyan Street, Fern Drive, Rose Lane, Oleander Place, Iris Drive, Hemlock Avenue, and Hawthorne Drive in the Barstow area. All work for the Project will be done within the existing road right-of-way.
On August 3, 2022, the Department of Public Works’ (Department) environmental staff reviewed this Project and determined that a categorical exemption in accordance with the California Environmental Quality Act (CEQA) Guidelines, Title 14 of the California Code of Regulations, Section 15301(c) Class 1 and Section 15302(c) Class 2 are appropriate. The Class 1 exemption is specific to existing highways and streets, sidewalks, gutters, bicycle and pedestrian trails, and similar facilities. The exemption allows for the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The Class 2 exemption allows for the replacement or reconstruction of existing structures and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced. When the Board of Supervisors (Board) considers the environmental finding, the filing and posting of a Notice of Exemption is recommended.
This Project was prioritized by the Board as part of the Measure “I” Local Street Pass-Through Funds Five-Year Capital Improvement Plan Project List for 2024-25 through 2028-29, approved on August 20, 2024 (Item No. 67).
The Project includes an allowance in the amount of $20,000 for unforeseen differing site conditions.
The Project aligns with the County and the Chief Executive Officer’s goals and objectives of ensuring the development of a well-planned, balanced, and sustainable County by preserving and improving the structural integrity of existing road surfaces.
PROCUREMENT
The Project will be advertised to invite formal bids in accordance with Section 22037 of the California Public Contract Code. The Department anticipates returning to the Board for an award of the construction contract in Spring 2025.
